AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR A CONDITIONAL
USE PERMIT ON PROPERTY ZONED R-2 AND R-3 ON THE EAST SIDE OF HARVEY
ROAD IN THE 1100 BLOCK AKA 1114 HARVEY ROAD, WITHIN THE CITY OF
AUBURN, WASHINGTON.
WHEREAS, a petition dated March 10, 1981, together with plot plans and
exterior elevations therefor, has been submitted to the Council of the City
of Auburn, by Ken Erickson and Duncan Bonjorni, requesting a Conditional Use
Permit on property zoned R-2 and R-3 for the purpose of constructing a Dental
Office on a parcel of land zoned R-2 (Single Family), and R-3(Duplex) on
the east side of Harvey Road in the 100 block also known as 1114 Harvey Road,
within the City of Auburn, Washington, which property hereinafter legally
described in Section 1 of this Ordinance and which property presently carries
an R-2 (Single Family)and R-3 (Duplex) classification; and
WHEREAS, said request above referred to was referred by the City Council
to the City rPlanning?Commission for study and public hearing thereon; and
WHEREAS, the Planning Commission held a public hearing to consider the
request in the Council Chambers of the Auburn City Hall, at 7:30 P.M. on
April 6, 1981, and subsequent thereto, the City Planning Commission approved
the issuance of a Conditional Use Permit on property zoned R-2 and R-3,
finding that the proposed use illustrated by the site development plans of the
petitioner would not be unduly detrimental to the adjacent and surrounding
properties and the enjoyment thereof; and
WHEREAS, the City Council of the City of Auburn, held a public hearing to
consider said petition in the Council Chambers of the Auburn City Hall at S:00 P.M.
on May 4, 1981, at the conclusion of which the City Council concurred with the
recommendations of the Planning Commission as hereinabove stated;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. That:a Conditional Use Permit on property zoned R-2 (Single
Family) and R-3 (Duplex)?be granted for the purpose of constructing a Dental
Office on a parcel of land zoned R-2 (Single Family), and R-3 (Duplex) on the
east side of Harvey Road in the 1100 block also known as 1114 Harvey Road,
situated in the City of Auburn, County of King, State of Washington, and legally
described as follows:
Parcel A: Lots 1.8, 19, and 20, and that por of Lots 21,
22, 23, and 24, Blk 16 of C.D. Hillmans Auburndale Addition
to the City of Seattle, Division No. 2 as per plat recorded
in Vol 13 of Plats, pg 92, Records of King County, Wa. lyg
NEIy of Harvey Road No. 2358, as condemned in King County
Superior Court Cause No. 225235; and Except the N 155 ft
thof; situated in the County of King, State of Washington.
Together with a nonexclusive easement 16 ft in width, for
ingress and egress for pedestrian and vehicular traffic and
for utilities over, across, upon and underneath the north
16 ft of the Ely 185 ft of the foll desc property:
Parcel B: That por of Lots 8 thru 14, Blk 16, C.D.
Hillmans Auburndale Add. to City of Seattle, Divsion #2,
accdg to the plat thereof recorded in Vol 13 of Plats,
pg 92, in King County, lyg NEIy of E.E. Harvey Road,
County Road No. 2358, EXCEPT that por of sd lots lyg Sly
of a In rnng N 86°46'00" E 162.70 ft from a pt on the NEIy
margin of sd Road to a pt 97.01 ft Sly of the NE cor of
Lot 14. Situated in the County of King, State of Washington.
in accordance with the plot plans and exterior elevations for said development
submitted with the request for a Conditional Use Permit on property zoned R-2,
a copy of which is attached hereto, designated as Exhibit "A" and by this reference
made a part hereof as though set forth in full herein.
Section 2. Consideration should be given to any requirements of the Public
Works Department for the City of Auburn.
Section 3. That the Conditional Use Permit shall be null and void if
construction has not been commenced within one year after the adoption of this
Ordinance.
Section 4. The Planning Director of the City of Auburn, Washington, is hereby
authorized and directed to file a certified copy of this Ordinance with the King
County Auditor.

Section 5. This Ordinance shall take effect and be in force five (5)
days from and after its passage, approval and publication, as provided by
law
