J ORDINANCE NO. 3 6 3 8 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR A CONDITIONAL USE PERMIT ON PROPERTY ZONED R-2 ON A PARCEL OF LAND 20.1 ACRES IN SIZE LYING BETWEEN A POINT 450 FEET EAST OF "I" STREET N.E. AND THE GREEN RIVER AND LYING NORTH OF BRANNAN PARK, WITHIN THE CITY OF AUBURN, WASHINGTON. WHEREAS, petition dated January 30, 1981, together with plot plans and exterior elevations therefor, has been submitted to the Council of the City of Auburn, by D. M. YOUNG CONSTRUCTION CO., INC., requesting a Conditional Use Permit on property zoned R-2, to construct a zero lot line subdivision on a parcel of land 20.1 acres in size lying between a point 450 feet east of "I" Street N.E. and the Green River and lying north of Brannan Park, within the City of Auburn, Washington, which property hereinafter legally described in Section 1 of this Ordinance and which property presently carries an R-2 (Single Family) classification; and WHEREAS, said request above referred to was referred by the City Council to the City Planning Commission for study and public hearing thereon; and WHEREAS, the Planning Commission held Fa public hearing to consider the request in the Council Chambers of the Auburn City Hall, at 7:30 P.M. on March 3, 1981, and subsequent thereto, the City Planning Commission approved the issuance of a Conditional Use Permit on property zoned R-2, finding that the proposed use illustrated by the site development plans of the petitioner would not be unduly detrimental to the adjacent and surrounding properties and the enjoyment thereof; and WHEREAS, the City Council of the City of Auburn, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall at 8:00 P.M. on April 6, 1981, at which time the public hearing was closed and referred the matter to the Street and Planning and Community Development Committees for review thereon; and --------------------- Ordinance No. 3638 Page One 5-13-81 WHEREAS, the City Council of the City of Auburn, considered said petition in the Council Chambers of the Auburn City Hall at 8:00 P.M. on May 4, 1981, at the conclusion of which the City Council concurred with the recommendations of the Planning Commission as hereinabove stated; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That a Conditional Use Permit on property zoned R-2 (Single Family) be granted to construct a zero lot line subdivision on a parcel of land 20.1 acres in size lying between a point 450 feet east of "I" Street N.E. and the Green River and lying north of Brannan Park, situated in the City of Auburn, County of King, State of Washington, and legally described as follows: That por of the Harvey H. Subject to a sewer easement over the south 15.00 ft, thof, as recorded under Auditors File No. 5492373. Subject to a powerline easement, no width available, as recorded under Auditors File No. 2084995. in accordance with the plot plans and exterior elevations for said development submitted with the request for a Conditional Use Permit on property zone R-2, a copy of which is attached hereto, designated as Exhibit "A" and by this reference made a part hereof as though set forth in full herein. Section 2. That the zero lot line be allowed on one lot,line only, all other setbacks as outlined under the R-2 Single Family designation shall be conformed to with the exception of the front yard which may be reduced to 20 feet. -------------------- Ordinance No. 3638 Page Two 5-13-81 Section 3. That no recreation vehicles, including travel trailers, boats, boat trailers and motor homes will be permitted to park on the street or in any uncovered space upon any lot. All such vehicles must be stored either in garages or carports and must be totally covered with no portion of the vehicle protruding. Section 4. On-street parking shall be allowed on one side of the private streets only. The other side shall be designated and signed as fire lane with on-street parking prohibited. Section 5. The cul-de-sacs shall be constructed with a roadway radius of 32.5 feet. There shall be no on-street parking within the cul-de-sac turn-around area. Section 6. Consideration shall also be given to any requirements of the Public Works and Fire Departments. Section 7. Sections 2 through 5 shall be included in the restrictive covenants of the homeowners association and shall have the authority to enforce these restrictions. In the event that they are not enforced, the association shall grant the authority to enforce them to the City of Auburn. These covenants shall be subject to the approval of the City Attorney. Section 8. That the Conditional Use Permit shall be null and void if construction has not been commenced within one year after the adoption of this Ordinance. Section 9. The Planning Director of the City of Auburn, Washington, is hereby authorized and directed to file a certified copy of this Ordinance with the King County Auditor. -------------------- Ordinance No. 3638 Page Three 5-13-81 Section 10.
