HomeMy WebLinkAbout3649ORDINANCE NO. 3 6 4 9 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF A PARCEL OF LAND APPROXIMATELY 80 ACRES IN SIZE LOCATED 1300 FEET WEST OF THE WEST VALLEY HIGHWAY AND SOUTH OF 15TH STREET N.W., WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM UNCLASSIFIED TO C-3 AND R-2 WITH A CONDITIONAL USE PERMIT. WHEREAS, a petition dated July 21, 1980, together with plot plans and exterior elevations therefor, has been submitted to the Council of the City of Auburn, by ROBERT LLOYD, requesting the rezoning of a parcel of land approximately 80 acres in size located 1300 feet west of the West Valley Highway and south of 15th.Street N.W., within the City of Auburn, Washington, changing the zoning classification thereof from Unclassified to C-3 (Heavy Commercial) and R-2 (Single Family) with a Conditional Use Permit, for the con- struction of cluster type housing, which property hereinafter legally described in Section 1 of this Ordinance; and WHEREAS, said request above referred to was referred by the City Council to the City Planning Commission for study and public hearing thereon; and WHEREAS, the Planning Commission held a public hearing to consider the request in the Council Chambers of the Auburn City Hall, at 7:30 P.M. on September 3, 1980, at which time the matter was tabled; and WHEREAS, the Planning Commission held a public hearing to consider the request in the Council Chambers of the Auburn City Hall, at 7:30 P.M., on May 5, 1981, and subsequent thereto, the City Planning Comission approved the re- zoning of a parcel of land approximately 80 acres in size located 1300 feet west of the West Valley Highway and south of 15th Street N.W., within the City of Auburn; changing the zoning classification thereof from Unclassified to C-3 and R-2 with a Conditional Use Permit, finding that the proposed use illustrated by the site development plans of the petitioner would not be unduly detrimental to the adjacent and surrounding properties and the enjoyment thereof; and --------------------- Ordinance No. 3649 Page One 6-11-81 WHEREAS, the City Council of the City of Auburn, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall at 8:00 P.M. on June 1, 1981, at the conclusion of which the City Council concurred with the recommendations of the Planning Commission as hereinabove stated; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the rezoning of a parcel of land approximately 80 acres in size located 1300 feet west of the West Valley Highway and south of 15th Street N.W., within the City of Auburn, Washington, changing the zoning classification thereof from Unclassified to C-3 (Heavy Commercial) and R-2 (Single Family) with a Conditional Use Permit be granted for the construction of cluster type housing, and which is legally described as follows: PARCEL I. Beginning at the northeast corner of the northwest quarter of the southeast quarter of Section 11, TWP 21 N, R 4 EWM, City of Auburn, King County, WA; Thence North 89°55'42" West a distance of 450.00 feet; Thence South 1°11'52" West a distance of 120.00 feet; Thence South 33°34'06" East a distance of 87.67 feet; Thence South 1°11'52" West a distance of 292.00 feet; Thence South 33°57'47" East a distance of 355.91 feet; Thence South 89°55'42" East a distance of 195.00 feet; Thence North 1°11'52" East a distance of 380.00 feet; Thence North 88°48'08" West a distance of 169.90 feet; Thence North 1°11'52" East a distance of 199.96 feet to a point of curve; Thence along a curve to the right an arc distance of 263.69 feet to a point of tangency, said curve having a radius of 170.00 feet and a central angle of 88°52'26"; Thence South 88°55'42" East a distance of 3.24 feet; Thence North 1°11'52" East a distance of 30.01 feet, more or less, to the point of beginning. Section 2. That Parcel I as legally described in Section 1 of this Ordinance, be zoned C-3 Heavy Commercial. Section 3. That the balance of the site designated as Parcel II legally described in Section 1 of this Ordinance, shall be zoned R-2 Single Family with a density of six (6) dwelling units per acre based upon the gross area. Section 4. That the approximately 5.4 acres of land located in the southwest corner of the site be subdivided for detached single family dwellings. with.a minimum lot area of 8,000 square feet of lot area with a maximum of seven (7) dwelling units as shown on the overall site plan (.See attached Exhibit "All). Section 5. That the balance of the site be developed for cluster type dwelling units in accordance with the configuration as shown on the overall site plan (See attached Exhibit "A"). --------------------- Ordinance No. 3649 Page Three 6-11-81 Section 6. That the overall site plan designated as Exhibit "A" shall be attached hereto and become a part of the Conditional Use Permit. Section 7. This Conditional Use Permit shall expire on September 15, 1985, unless extended by the Auburn City Council. Section 8. The Planning Director of the City of Auburn, Washington, is hereby authorized and directed to file a certified copy of this Ordinance with the King County Auditor. Section 9. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
