IN THE 3300-3400 BLOCKS,''AITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM R-3 TO R-4. WHEREAS, a petition has been submitted to the Council of the City of Auburn, Washington, by John Kingman, requesting the rezoning of the real property hereinafter described in Section 1 of this Ordinance, which petition was dated January 27, 1981; and 11HERE,AS, said request above referred to, was referred to the Planning Commission by and the Auburn City Council for study and public hearing thereon; and WHEREAS, the Planning Commission held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on March 3, 1981, at 7:30 P.M., at the conclusion of which the Planning Commission recommended the approval of the rezoning of the said property; and WHEREAS, the City Council of the City of Auburn, held a public Bearing in the Council Chambers of the Auburn City Hall at 8:00 P.M. on April 6, 1981, at which time the City Council tabled the request until the regular City Council Meeting on June 15, 1981; and WHEREAS, The City Council of the City of Auburn, at their regularly scheduled City Council Meeting, held on June 15, 1981, at 8:00 P.M. in the Council Chambers of the Auburn City Hall, concurred with the recommendations of the Planning Commission, as hereinabove stated. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the following described property located on a parcel of land on the West side of "M" Street S.E. in the 3300 - 3400 Blocks, situate in the City of Auburn, County of King, State of Washington, be and the same is hereby rezoned from R-3 (Duplex) to R-4 (Multi-Family), to-wit: Lot 4 of City of Auburn Short Plat No. SP-19-78 as recorded under King County Auditors File No. 7809200302 situated in Section 30, Twp 21 N, R 5 EWM City of Auburn, County of King, State of Washington. ---------------------- Ordinance No. 3651 Page One 6-25-81 Section 2. That the amendment to the Comprehensive Zoning Map of the City of Auburn, Washington, encompassing this zoning use classification change, which amendment is designated as Exhibit "A"hereof, be and the same is hereby approved. Section 3. That the Planning Director for the City of Auburn, Washington, is hereby authorized and directed to file a certified copy of this Ordinance with the King County Auditor. Section 4. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law. O ("9 O O ei C N GO 60 31-S-7 • r AGREEMENT 60 /7 ,5'17 /04 THIS AGREEMENT made and executed in triplicate this 5th day of August 1981 by and between the CITY OF AUBURN, a municipal corporation of the State of Washington, hereinafter referred to as City, and JOHN E. KINGMAN and MARLENE MARIE KINGMAN, his wife, 'S2. Fi hereinafter referred to as "OWNERS". WITNESSETH That WHEREAS, it is proposed to request the Mayor and City Council of City to change from R-3 Duplex, to R-4 Multi-Family, the property hereinafter described in Section 1 of this Agreement; and, WHEREAS, it is believed that the rezoning of said area as above described will be in the public interest, welfare and convenience of the City of Auburn; and, WHEREAS, the Owners agree as a part of said consideration to layout, develop and maintain said property to be rezoned as hereinafter set forth; NOW, THEREFORE, THIS AGREEMENT WITNESSETH THAT FOR AND IN CONSIDERATION OF THE MAYOR AND CITY COUNCIL OF CITY PASSING AN ORDINANCE CHANGING THE ZONING USE CLASSIFICA- TION OF SAID PROPERTY HEREINAFTER DESCRIBED FROM R-3 DUPLEX TO R-4 MULTI-FAMILY, AND OF THE MUTUAL BENEFITS TO EACH OF THE PARTIES HERETO, THE PARTIES, THEIR RESPECTIVE SUCCESSORS AND ASSIGNS DO HEREBY COVENANT AND AGREE AS FOLLOWS: Section 1. The Owners agree to layout, develop and maintain the hereinafter described property, to wit: Lot 4 of City of Auburn Short Plat No. SP-19-78 as recorded under King County Auditors File No. 7809200302 situated in Section 30, Twp 21 N, R 5 EWM City of Auburn, County of King, State of Washington. In accordance with site development plans prepared by the Owners and approved by the Public Works Department of the City prior to the time any building permits for con- struction in the above described property are to be issued by the City of Auburn. Section 2. The Owners further agree that the following special conditions shall apply and as such shall constitute material consideration as and for this Agreement: 1. That the site be subdivided in accordance with the subdivision ordinance of the City of Auburn. Pare One • Secti0li 2. Cont'd 2. That the subdivision be in accordance with the site plan submitted and attached hereto as Exhibit "A". 3. That the subdivision contain not more than ten (10) building lots. 4. That not more than one (1) four-plex together with any accessory buildings be constructed on each lot. 5. That no building permits be issued on the site until a final plat has been approved and recorded. Section 3. Owners further agree to comply with all applicable rules, regulations, ordinances and laws of the City of Auburn, relative to development of the property O described above. eOi Section 4. It is understood and agreed by and between the parties hereto that the provisions of this Agreement shall be binding upon and enforceable against the Owners, their successors and assigns, and all subsequent owners, their respective heirs, successors, and assigns of the property herein described. Section 5. An executed copy of this Agreement shall be recorded among the land records of the County Auditor in and for the County of King, State of Washington.
