E 22 ORDINANCE NO. 3 6 5 9 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE ANNEXATION TO THE CITY OF AUBURN OF A CONTIGUOUS AREA OF LAND LYING ON THE WEST SIDE OF AUBURN WAY NORTH IN THE 5000 BLOCK AKA 27807 EAST VALLEY ROAD SOUTH, WHICH LAND IS DESCRIBED IN A PETITION DULY FILED WITH THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON. WHEREAS, the City Council of the City of Auburn was notified by owners of property having more than ten percent in value of the assessed valuation within the proposed area to be annexed, that they desired to circulate a petition to commence annexation proceedings to the City of Auburn; and WHEREAS, the City Council of the City of Auburn subsequently authorized the circulation of the petition within the proposed area to be annexed; and WHEREAS, the petition for annexation of the property hereinafter described was duly filed with the City Council of the City of Auburn on the 6th day of April, 1981, which petition was signed by the owners of more than 75'/o in value of all of the property lying within the limits of the proposed area to be annexed according to the assessed valuation for general taxation of the property for which an annexation is petitioned, said petition setting forth the legal description of the property to be annexed and being accompanied by a plat outlining the boundaries of said area sought to be annexed; and WHEREAS, the City Council of the City of Auburn fixed a date for public C? hearing to be held at 8:00 P.M. in the Council Chambers of the Auburn City Hall on April 20, 1981, setting forth notice of said public hearing for annexation to be published in the official City newspaper of the City of Auburn in one issue) of said newspaper, and providing for the posting in three public places within the area proposed for annexation of copies of said notice of public hearing; and WHEREAS, notice of public hearing of said petition of annexation to the City of Auburn has been duly published in the official newspaper of the City of Auburn in one regular issue of said newspaper, and the said notice of public hearing having been posted in three public places within the area proposed for t<f•-tit l!T j,E41 -------------------- ?R Ordinance No. 3659 ?CT 307 FM Page One 7-8-81 By °? !L'*) OF RAC KING GO <tIN' 10N CIO M 1Z O' qtY C:) annexation by the City Clerk of the City of Auburn, and said public hearing being held at 8:00 P.M. in the Council Chambers of the Auburn City Hall on April 20, 1981, and the City Council of the City of Auburn having determined that said annexation is in the best interest and welfare of the City of Auburn, did accept and approve the petition above described and directed the filing of a notice of its intention to annex the hereinafter described property with the Boundary Review Board as required by Section 9 of Chapter 189 of Laws of the State of Washington for the year 1967; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AS FOLLOWS: Section 1. That the petition for annexation of the property hereinafter described in Section 6 of this Ordinance has been duly and properly filed with the City Council of the City of Auburn, and complies with all requirements of law. Section 2. That by regular motion adopted and passed by the City Council on the 6th day of April, 1981, it was ordered that a public hearing be had on said petition for the annexation at 8:00 P.M. in the Council Chambers of the Auburn City Hall on April 20, 1981, providing for the proper notice to be published and posted according to law. Section 3. That proper notice of public hearing was duly published in the GD official newspaper of the City of Auburn, and was duly posted in three public a C? places within the area proposed for annexation hereinafter described, and that a public hearing was held at 8:00 P.M. in the Council Chambers of the Auburn City 1 Hall on the 20th day of April, 1981. . Section 4. That at the conclusion of the public hearing in the City Hall Council Chambers of the City of Auburn on the 20th day of April, 1981, the City Council did approve the petition for annexation and directed the filing of a notice of its intention to annex the hereinafter described property with the Boundary Review Board as required in Section 9 of Chapter 189 of the State of Washington Laws for the year 1967. -------------------- Ordinance No. 3659 Page Two 7-8-81 Section 5. That notice of intention to annex was filed with the Boundary Review Board effective May 13, 1981, and the Boundary Review Board received no request for review and did not itself choose to invoke jurisdiction; therefore, inasmuch as the sixty day period subsequent to filing provided for in RCW 36.93.100 (n M has elapsed, the Notice of Intention was deemed approved as of June 11, 1981 and the Boundary Review Board forwarded their findings to the City Council of the City 0 of Auburn. co Section 6. That the property lying contiguous on the west side of Auburn Way North in the 5000 block, also known as 27807 East Valley Road South, herein- after described be and the same is hereby annexed to the City of Auburn, said property being more particularly described as follows, to-wit: That portion of Tract 30, 31 and 32 of White River Valley Home Tracts as per plat recorded in Volume 13 of Plats, on page 17, records of King County, WA. described as follows: Beginning at the intersection of the west line of Tract 30 with the south. line of R.H. Beatty D.C. #37; thence S 0°10'32" W 300 ft; thence S. 89°49'28" E to a point on the Auburn City Limits, Auburn Ordinance No. 2511, also the TPOB of this description; thence N 89°49' 28" W to the west line of said Tract 30; thence S 0°10' 32" W 370.8 feet; thence S 89°49'28" E 211.21 ft; thence south to a point on the west line of Tract 31 which is 673.53 ft south of the NW cor of said Tract 31; thence S 88°02'00" E 115 ft; thence S 01°58'00" W 70 ft; thence S 88°02'00" E 230.45 ft to said Auburn City Limits; thence northwesterly along said City Limits to the TPOB located in King County, Washington. That the effective date of the annexation of the above described Section 7 . property to the City of Auburn shall be the effective date of the passage of this Ordinance providing for such annexation. Section 8.
