HomeMy WebLinkAbout3660 ORDINANCE NO. 3 6 6 0 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR A CONDITIONAL USE PERMIT ON PROPERTY ZONED R-2 ON A PARCEL OF LAND 14,000 SQUARE FEET IN SIZE, AND LOCATED AT 7TH AND "I" STREETS N.E. AKA 710 "I" STREET N.E., WITHIN THE CITY OF AUBURN, WASHINGTON. WHEREAS, petition dated April 9, 1981, together with plot plans and exterior elevations therefor, has been submitted to the Council of the City of Auburn, by L. HOEFERT, D. McMULLEN and R. HOLZ, requesting a Conditional Use Permit on property zoned R-2, for a day care center on a parcel of land 14,000 square feet in size, and located at 7th and "I" Streets N.E., also known as 710 "I" Street Northeast, within the City of Auburn, Washington, which property hereinafter legally described in Section 1 of this Ordinance and which property presently carries an R-2 (Single Family) classification; and WHEREAS, said request above referred to was referred by the City Council to the City Planning Commission for study and public hearing thereon; and WHEREAS, the Planning Commission held a public hearing to consider the request in the Council Chambers of the Auburn City Hall, at 7:30 P.M. on June 2, 1981, and subsequent thereto, the City Planning Commission approved the issuance of a Conditional Use Permit on property zoned R-2, finding that the proposed use illustrated by the site development plans of the petitioners would not be unduly detrimental to the adjacent and surrounding properties and the enjoyment thereof; and WHEREAS, the City Council of the City of Auburn, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall at 8:00 P.M. on July 6, 1981, at the conclusion of which the City Council concurred with the recommendations of the Planning Commission as hereinabove stated; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: ------------------ Ordinance No. 3660 Page One 7-13-81 , , Section 1. That a Conditional Use Permit on property zoned R-2 (,Single Family) be granted for the purpose of operating a child day care center on a parcel of land 14,000 square feet in size, and located at 7th and "I" Streets Northeast, also known as 710 "I" Street Northeast, situated in the City of Auburn, County of King, State of Washington, and legally described as follows: That por of GL 9 of Sec 18, Twp 21 N, R 5 EWM desc as foll: Beg 217.6 ft E of the NW cor of sd Subd; th S pll to the W In of sd Subd, 310 ft; th S 89°20' E 177.4 ft; Th N pll to the W In of sd subd 321.5 ft; th S 86°57'W 177.65 ft to the POB; Except the E 90 ft of the N 321.50 ft thof; And Except the W 87.4 ft of the N 150 ft thof; Together with an easement for ingress, egress and utilities over, under and across the following desc tract: That por of GL 9 in Sec 18, Twp 21 N, R 5 EWM, desc as foll: Beg 320.25 ft E of the NW cor of sd subd; th S 86°57' W 15.25 ft; Th S pllto the W In of sd subd 180 ft; th N 86°57' E 15.25 ft; th N pllw the W In of sd subd 180 ft m/1 to the POB; situate in the County of King, State of Washington. in accordance with the plot plans and exterior elevations for said development submitted with the request for a Conditional Use Permit on property zoned R-2, a copy of which is attached hereto, designated as Exhibit "A" and by this reference made a part hereof as though set forth in full herein. Section 2. A maximum of 32 children be maintained at the day care center. Section 3. That the Conditional Use Permit be issued to RON and DIANA HOLZ only and is nontransferable. Section 4. Consideration should also be given to the recommendations of the Public Works. Department as set forth.in their memo dated May 20, 1981. Section 5. At no time will the play area abut any single family residences. Section 6. The Planning Director of the City of Auburn, Washington, is hereby authorized and directed to file a certified copy of this Ordinance with the King County Auditor. -------------------- Ordinance No. 3660 Page Two 7-13-81 4 Section 7. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law. Hoefert and D. McMullen as additional permitees under the above cited Conditional Use Permit.
