AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE CONSTRUCTION
AND INSTALLATION OF WATER MAIN AND FIRE HYDRANTS, SANITARY SEWER AND
APPURTENANCES, 24-FOOT STREET, PAVING, CURB AND GUTTER, SIDEWALK,
STORM DRAINAGE AND STREET LIGHTS ON "B" STREET N.W. BETWEEN 37TH
STREET N.W. AND NORTH CITY LIMITS, WITHIN THE CITY OF AUBURN,
WASHINGTON; CREATING AND ESTABLISHING LOCAL IMPROVEMENT DISTRICT
NO. 322; PROVIDING THE METHOD OF ASSESSMENT IN SAID DISTRICT AND
THE MODE OF PAYMENT THEREOF, AND CREATING A LOCAL IMPROVEMENT FUND
THEREFOR.
WHEREAS, a petition has been filed with the City Council of the City of
Auburn, signed by the owners of the property aggregating a majority (1) of the
lineal frontage upon the improvement and (2) of the area within the proposed
district, setting forth the nature and territorial extent of the proposed im-
provement, the mode of payment and what proportion of the lineal frontage upon
the improvement and of the area within the proposed district is owned by the
petitioners as shown by the records in the office of the County Auditor for
King County, Washington, petitioning for the construction and installation of
water main and fire hydrants, sanitary sewer and appurtenances, 24-foot street,
paving, curb and gutter, sidewalk, storm drainage, and street lights, on "B"
Street Northwest between 37th Street Northwest and north city limits, within
the.City of Auburn, Washington; and
WHEREAS, the City Engineer has caused an estimate to be made on the cost
and expense of the proposed improvement and has certified said estimates to the
City Council, together with all papers and information in his possession touching
the proposed improvements, a description of the boundaries of the district, a
statement of what portion of the costs and expense of the improvements should be
borne by the property within the proposed district, a statement in detail of any
local improvement assessments outstanding and unpaid against the property in the
proposed district, and a statement of the aggregate actual valuation of the real
estate and the actual valuation of the improvements in the proposed district
according to the valuation last placed upon it for the purpose of general taxation;

WHEREAS, said estimates are accompanied by a diagram of the proposed
improvements showing thereon the lots, tracts and parcels of land and other
property which will be especially benefitted by the proposed improvements and
the estimated amount of the cost and expense thereof to be borne by each lot,
tract and parcel of land or other property.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. That "B" Street Northwest between 37th Street Northwest and
north city limits, inside the corporate limits of the City of Auburn, be
improved by the construction and installation of water main and fire hydrants,
sanitary sewer and appurtenances, 24-foot street, paving, curb and gutter,
sidewalk, storm drainage, and street lights, all in accordance with plans and
specifications prepared by the City Engineer and filed with the City Clerk.
Section 2. That there is hereby created and established a Local Improvement
District to be designated Local Improvement District No. 322, which said district
is described as follows, to-wit:
Lots 1 and 2 City of Auburn Short Plat No. 27-78 as recorded
under King County Auditors File No. 7810190517.
Lots 16, 17, 18, and 19 White River Home tracts as recorded
in Volume 13 of Plats, page 17, records of`King:County, WA.
Section 3. That the estimated costs in carrying out the foregoing im-
provement is hereby declared to be as near as may be, the sum of $523,287.60..
Section 4. Applicable costs and expenses of all engineering, legal,
inspection, advertising, publication and notices, and all other expenses incident
thereto, shall be levied and assessed against all of the property legally and
properly assessable therefor, as provided by the laws of the State of Washington
and the Ordinances of the City of Auburn.
Section 5. That said improvements shall be made by the City of Auburn under
the supervision of the City Council thereof or such committee or person as the
City Council may designate.

Section 6. Assessments or any portion thereof, may be paid at any time
within thirty (30) days from the date of the first publication of the Notice of
Collection of such assessments without penalty, interest, or costs, and thereafter
the sum remaining unpaid, if any, may be paid in ten (10) equal annual install-
ments, with interest on the whole unpaid sum at the rate of one-half (1/2) of
one percent (1%) in excess of the net effective rate of the Local Improvement
District bonds with the interest in no case being greater than thirteen percent
(13%).
Commencing with the first year after the last day, such assessments, or
any portion thereof, may be paid without penalty, interest or cost (thirty (30)
days from the date of the first publication of the Treasurer's Notice of Collection
of Assessments) and each year thereafter one of said installments, together with
the interest due, shall be collected as provided by law and the Ordinances of the
City of Auburn; assessments or installments of assessments not paid when due shall
be delinquent and there shall be added to the same a penalty of twelve percent
(12%) of the amount of the overdue installments and interest, and such penalty
shall become a part of the lien upon the property assessed.
Section 7. That there is hereby created in the office of the Finance
Director for the City of Auburn, Washington, a fund of the City to be known as
"Local Improvement District No. 322 Fund". ;Warrants shall be drawn on said fund
based on estimates made by the City Engineer and approved by the City Council in
payment of the costs of construction and installation of said improvements.
Section 8. This Ordinance shall take effect and be in force five (5) days
from and after its passage, approval and publication, as provided by law..

I certify that said Ordinance No. 3663 was duly passed by the Council
and approved by the Mayor of the said City of Auburn, on the 3rd day of
Aupist A.D., 19 81 .
I further certify that said Ordinance No. 3663 was published as provided
by law in the Daily Globe News, a daily newspaper published in the City of
Auburn, and of general circulation therein, on the 11th day of August
