AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF
A PARCEL OF LAND 40 ACRES IN SIZE LOCATED ON THE WEST SIDE OF ORAVETZ
ROAD IN THE 1800-1900 BLOCK, WITHIN THE CITY OF AUBURN, WASHINGTON,
CHANGING THE ZONING CLASSIFICATION THEREOF FROM UNCLASSIFIED TO C-N
AND R-2 WITH A CONDITIONAL USE PERMIT FOR CLUSTER HOUSING.
WHEREAS, a petition dated February 25, 1980, has been submitted to the Council
of the City of Auburn, by LONDON SQUARE ASSOCIATES, requesting the rezoning of
property zoned Unclassified to R-2, R-4 and C-1 on a parcel of land 40 acres in
size located on the west side of Oravetz Road in the 1800-1900 block, within the
City of Auburn, which property hereinafter described in Section 1 of this Ordinance;
and
WEHREAS, said request above referred to was referred to the Planning
Commission by the Auburn City Council for study and public hearing thereon; and
WHEREAS, the Planning Commission held a public hearing to considerisaid
petition in the Council Chambers of the Auburn City Hall, on May 6, 1980, at
7:30 P.M., at which time the Commission denied the request to rezone from
Unclassified to R-2, R-4 and C-1 and recommended the approval of the rezoning
from Unclassified to C-N and R-2 with a Conditional Use Permit for cluster
housing; and
WHEREAS, the City Council of the City of Auburn, held a public hearing
in the Council Chambers of the Auburn City Hall, at 8:00 P.M. on June 2, 1980,
at which time the City Council closed the public hearing and referred the matter
to the Planning and Community Development Committee for recommendations and
preparation of an Environmental Impact Statement; and
WHEREAS, on July 14, 1981, said Planning and Community Development Committee
recommended that the Auburn City Council approve the request in accordance with
the Planning Commission recommendations; and
WHEREAS, on July 20, 1981, the Auburn City Council approved the request for
the rezone from Unclassified to C-N and R-2 with a Conditional Use Permit for
cluster housing.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That the portion of property zoned from Unclassified be rezoned
to C-N (Neighborhood Shopping District) on a parcel of land approximately five (5)
acres in size and legally described as follows, to-wit:
Commencing at the intersection of the South line of the South
1/2 of the Northwest 1/4 of Section 32, Township 21 North, Range
5 East, W.M. in King County, Washington, and the Southwesterly
margin of Oravetz Road, said point also being the southeasterly
boundary corner of that certain parcel of land commonly known as
London Square;
Thence N 39°19'58" West along said Southwesterly margin of Oravetz
Road a distance of 131.75 feet to the true point of beginning;
Thence N 88°42'40" West along a line that is parallel to and 100
feet North of the South line of said South 1/2 a distance of 385.47
feet;
Thence N 04°26'46" West a distance of 171.15 feet;
Thence N 52°53'14" East a distance of 197.18 feet to a point on
said Southwesterly margin of Oravetz Road;
Thence S 36°23'58" East along said Southwesterly margin of Oravetz
Road a distance of 45.76 feet;
Thence continuing along said Southwesterly margin S 39°19'58" East
a distance of 338.02 feet more or less to the true point of beginning.
All situated in the County of King, State of Washington. (Said parcel
containing 1.612 acres more or less.)
TOGETHERWITH:
Commencing at the intersection of the South line of the South 1/2
of the Northwest 1/4 of Section 32, Township 21 North, Range 5 East,
W.M. in King County, Washington and the Southwesterly margin of Oravetz
Road, said point also being the southeasterly boundary corner of that
certain parcel of land commonly known as London Square;
Thence N 39°19'58" West along said Southwesterly margin of Oravetz
Road a distance of 469.77 feet;
Thence continuing along said Southwesterly margin of Oravetz Road N
36°23'58" West a distance of 105.76 feet to the true point of beginning;
Thence continuing along said Southwesterly margin of Oravetz Road N 36°
23'58" West a distance of 478.68 feet;
Thence S 52°53'14" West a distance of 252.76 feet;
Thence S 19°31'23" East a distance of 255.21 feet;
Thence S 37°06'46" East a distance of 235.36 feet;
Thence N 52°53'14" East a distance of 323.93 feet more or less to a point
on said Southwesterly margin of Oravetz Road, said point being the true
point of beginning.
All situated in the County of King, State of Washington. (Said parcel
containing 3.377 acres more or less).

Section 2. That the portion of property zoned from Unclassified be rezoned
to R-2 (Single Family) with a Conditional Use Permit be granted for the construction
of cluster housing on a parcel of land 35 acres in size located on the west side of
Oravetz Road in the 1800-1900 block, situated in the City of Auburn, County of King,
State of Washington, and legally described as follows, to-wit:
The South 1/2 of the NW 1/4 of Sec. 32, Twp 21 N, Range 5 EWM,
City of Auburn, King County, Washington.
EXCEPT County roads.
AND EXCEPT any portion thereof lying northerly and easterly of
Stuck River Road (Oravetz Road).
LESS that portion legally described in Section 1 of this Ordinance.
in accordance with the plot plans and exterior elevations for said development
submitted with the request for R-2 with a Conditional Use Permit, a copy of which
is attached hereto, designated as Exhibit "A" and by this reference made a part
hereof as though set forth in full herein.
Section 3. The C-N Neighborhood Shopping District Zone shall have a minimum
setback of fifty (50) feet from Oravetz Road and one hundred (100) feet from the
south property line. These setbacks shall be left.in a natural condition
augmented by plantings (trees, shrubs) where necessary as determined by the
Planning Department to provide a suitable screen. If grading of any portion
of this setback is required because of topography, a landscaping plan shall be
submitted to the Planning Department for their review and approval prior to
commencing the grading.
Section 4. That the balance of the site less the five (5) acres zoned
C-N Commercial shall be zoned R-2 Single Family with a Conditional Use Permit
to construct a maximum of six (6) living units per acre in accordance with the
site plan and made a part of this permit. Any modification of the site plan
shall be submitted to the City Council Planning and Community Development Committee
for their review and approval.

Section 5. The owner shall construct their portion of the Oravetz Road
or relocated Oravetz abutting the entire length of the site. All improvements
shall be constructed to the specifications as determined by the Auburn Public
Works Department.
Section 6. If no work has been started on the installation of public
improvements within the site within two (2) years after the Final Environmental
Impact Statement for the installation of water mains and sanitary sewers to serve
this and other properties in the vicinity by local improvement district, then
the zoning will revert back to the zoning classification of Unclassified.
Section 7. The Planning Director of the City of Auburn, Washington,
is hereby authorized and directed to file a certified copy of this Ordinance
with the King County Auditor.
Section 8. This Ordinance shall take effect and be in force five,(5)
days from and after its passage, approval and publication, as provided by law.
