AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF
A PARCEL OF LAND TWO ACRES IN SIZE LYING ON THE EAST SIDE OF CLAY
STREET NORTHWEST IN THE 400 BLOCK, SITUATE WITHIN THE CITY OF AUBURN,
WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM UNCLASSIFIED
TO M-1 WITH A CONDITIONAL USE PERMIT.
WHEREAS, a petition dated May 19, 1981, together with plot plans and
exterior elevations therefor has been submitted to the Council of the City of
Auburn, by PUGET SOUND POWER AND LIGHT COMPANY, requesting a Conditional Use
Permit which would allow for the construction of an electrical substation on
a parcel of land two (2) acres in size lying on the east side of Clay Street
Northwest, within the City of Auburn, Washington, which property hereinafter
described in Section 1 of this Ordinance and which property presently carries
an Unclassified classification; and
WHEREAS, said request above referred to was referred by the City Council
to the City Planning Commission for study and public hearing thereon; and
WHEREAS, the Planning Commission held a public hearing to consider the
request in the City Hall of the City of Auburn, at 7:30 P.M. on July 7, 1981,
and subsequent thereto the City Planning Commission approved the issuance of
the rezoning of M-1 (Light Industrial) with a Conditional Use Permit, finding
that the proposed use illustrated by the site development plans of the petitioner
would not be unduly detrimental to the adjacent and surrounding properties and
the enjoyment thereof; and
WHEREAS, the City Council of the City of Auburn held a public hearing to
consider said petition in the City Hall of the City of Auburn at 8:00 P.M. on
August 3, 1981, at the conclusion of which the City Council concurred with the
recommendations of the Planning Commission as hereinabove stated;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. That a Conditional Use Permit be granted for the purpose of
construction of an electrical substation on a parcel of land two (2) acres in
size lying on the east side of Clay Street Northwest in the 400 block, legally
described as follows:

premises by instrument recorded April 12, 1966 under
Auditors File No. 6013530.
in accordance with the plot plans and exterior elevations for said development
submitted with the request for Conditional Use Permit, a copy of which is attached
hereto, designated Exhibit "A" and by this reference made a part hereof as though
set forth in full herein. ,
Section 2. That the site plan and landscape plan be attached to and
become a part of the permit and development shall conform to these plans.
Section 3. That the west ten (10) feet of the site be dedicated for street
purposes for the future widening of Clay Street Northwest.
Section 4. That the owners agree to participate and sign any petition for
public improvements within the right of way on Clay Street when initiated by the
City or other property owners along Clay Street.
Section 5. That consideration be given to any requirements of the Public
Works and Fire Departments.
Section 6. That the Planning Director for the City of Auburn is hereby
authorized and directed to file a certified copy of this Ordinance with the
King County Auditor's Office.

Section 7. This Ordinance shall take effect and be in force five (5)
days from and after its passage, approval and publication, as provided by
law.
