AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING AUBURN CITY ORDINANCE
NO. 2826 (PASSED JULY 15, 1974) REQUESTING AN AMENDMENT TO AN EXISTING
CONDITIONAL USE PERMIT ON A PARCEL OF LAND LOCATED ON THE EAST SIDE OF
"W STREET S.E. IN THE 700 BLOCK, WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, a petition dated June 24, 1981, together with plot plans and
exterior elevations therefor has been submitted to the Council of the City of
Auburn, by the AUBURN AERIE #2298 FOE, requesting an amendment to an existing
Conditional Use Permit to construct a new lodge facility on a parcel of land on
the east side of "W Street Southeast in the 700 block. The original Conditional
Use Permit was authorized by Auburn City Ordinance No. 2826, passed July 15,
1974; and
WHEREAS, said request above referred to was referred by the City Council
to the City Planning Commission for study and public hearing thereon; and,
WHEREAS, the Planning Commission held a public hearing to consider the
request in the City Hall of the City of Auburn at 7:30 P.M. on July 7,1981,
and subsequent thereto the City Planning Commission approved the amendment to
the existing Conditional Use Permit, finding that the proposed use illustrated
by the site development plans of the petitioner would not be unduly detrimental to
the adjacent and surrounding properties and th~ enjoyment thereof; and
WHEREAS, the City Council of the City of Auburn held a public hearing to
consider said petition in the City Hall of the City of Auburn at 8:00 P.M. on
August 3,1981, at the conclusion of which the City Council concurred with the
recommendations of the Planning Commission as hereinabove stated;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. That an amendment to an existing Conditional Use Permit be
granted for the purpose of constructing a new lodge facility on a parcel of land
on the east side of "W Street Southeast in the 700 block. The original Conditional
Use Permit was authorized by Auburn City Ordinance No. 2826, passed July 15,
1974, and legally described as follows:

in accordance with the plot plans and exterior elevations for said development
submitted with the request for an amendment to an existing Conditional Use Permit,
a copy of which is attached hereto, designated Exhibit "A" and by this reference
made a part hereof as though set forth herein in full.
Section 2. That the recommendations included in the original Conditional
Use Permit authorized by Auburn City Ordinance No. 2826 be amended to include
the following conditions:
1. That the site plan be amended to show a landscaping area a minimum
of not less than twenty (20) feet in width between the east property line of
"W' Street Southeast and the new lodge building.
2. That the revised site plan be attached to and become a part of the
Conditional Use Permit.
3. That the building be restricted to one (l) story in height.
4. That a six {6} foot high screen fence be constructed along the north,
south and east property lines where off-street parking or driveways are con-
structed within 50 feet of a property line. A solid screen hedge may be
substituted provided it is a minimum of four (4) feet in height at the time of
planting.
5. That all outdoor lighting be directed away from private property
adjacent.
6. That there be no outside public address system.
7. That a landscaping plan prepared by a licensed landscape architect be
submitted for approval prior to the issuance of a building permit.

8. There sha 11 be no 1 i ghted sign withi n 100 feet of "M" Street
Southeast. A ground sign not more than 42 inches in height may be placed
in the landscaping area between "M" Street Southeast and the building. This
sign may contain the following F.O.E. #2298 and may have indirect lighting. The
same sign may be placed on the face of the building and shall have indirect
lighting. The size of the signs shall conform to the City of Auburn Sign Code.
9. In the event the City of Auburn Public Works Department determines
that in order to provide for traffic safety on "M" Street Southeast, a left-
turn lane should be constructed on "M" Street Southeast to accommodate the
left-turn traffic generated by this facility, the owners shall participate in the
construction of the left-turn lane in an amount to be determined by the Street
Committee of the City Council.
10. That a breakdown of the off-street parking requirement calculations
be submitted for review prior to the issuance of a building permit.
Section 3. The Planning Director for the City of Auburn, Washington,
is hereby authorized to file a certified copy of this Ordinance with the King
County Auditor's Office.
Section 4. Due to economic, hardships and delays involved in this
application not caused by the applicant herein, there is herewith declared
a public emergency necessary for the protection of public health, public
safety, public property and public peace, and upon its passage by a majority
plus one of the whole membership of the Auburn City Council, this Ordinance
shall be immediately effective.
