HomeMy WebLinkAbout3672ORDINANCE NO. 3 6 7 2 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR A CONDITIONAL USE PERMIT ON PROPERTY ZONED R-4 ON A PARCEL OF LAND 12.4 ACRES IN SIZE LOCATED ON THE SOUTH SIDE OF 29TH STREET SOUTHEAST IN THE 600-700 BLOCK, WITHIN THE CITY OF AUBURN, WASHINGTON. WHEREAS, petition dated April 6, 1981, together with plot plans and exterior elevations therefor, has been submitted to the Council of the City of Auburn, by N.A.N. Partners, requesting a Conditional Use Permit on property zoned R-4, for the construction of 145 cluster type single family units, on a parcel of land 12.4 acres in size located on the south side of 29th Street Southeast in the 600-700 block, within the City of Auburn, Washington, which property presently carries an R-4 (Multi-Family),classification; and WHEREAS, said request above referred to was referred by'the City Council to the City Planning Commission for study and public hearing thereon; and WHEREAS, THE Planning Commission held a public hearing to consider the request in the Council Chambers of the Auburn City Hall, at 7:30 P.M. on May 5, 1981, and subsequent thereto, the City Planning Commission approved the issuance of a Conditional Use Permit on property zoned R-4, finding that the proposed use illustrated by the site development plans of the petitioners would not be duly detrimental to the adjacent and surrounding properties and the enjoyment thereof; and WHEREAS, the City Council of the City of Auburn, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall at 8:00 P.M. on June 1, 1981, at which time the matter was referred to the Street Committee and referred to the Planning and Community Development Committee at the June 15, 1981, City Council Meeting; and WHEREAS, the City Council of the City of Auburn, at their regular City Council meeting of August 3, 1981, considered said petition in the Council Chambers of the Auburn City Hall at 8:00 P.M., at the conclusion of which the City Council con- curred with the recommendations•of the Planning Commission, as hereinabove stated; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: -------------------------- Ordinance No. 3672 Page One 8-12-81 Section 1. That a Conditional Use Permit on property zoned R-4 (Multi-Family) be granted for the purpose of constructing 145 cluster type single family units, on a parcel of land 12.4 acres in size located on the south side of 29th Street Southeast in the 600-700 Block, situated in the City of Auburn, County of King, State of Washington, and legally described as follows: Parcel "A" Lot 3 of City of Auburn Short Plat SP-13-76 recorded under King County Recording Number 7812050719, being a correction of said short plat recorded under Recording Numbers 7608130588 and 7807110287; said short plat being described as follows; " The SE 2 of the NW 12 of Sec 30, Twp 21 N, R 5 EWM in King County, Wash.; Less the N 30 feet for road. Parcel "B" The N 160 ft of the W z of the W } of the E } of the NE ; of the SW a lyg N or Willis Road, in Sec 30, Twp 21 N, R 5 EWM, in King County, Wash.; being known as Lot 1 of City of Auburn Short'Plat Number SP- 14-78 Revision recorded under Recording Number 8009290574. in accordance with the plot plans and exterior elevations for said development submitted with the request for a Conditional Use Permit on property zoned R-4, a copy of which is attached hereto, designated as Exhibit "A" and,by this reference made a part hereof as though set forth in full herein. Section 2. A building, structure or land shall not be used and a building or structure hereafter built, altered or enlarged shall be used for only the following permitted uses: A. One attached or detached single family dwelling, or condominium not to exceed one dwelling on any lot. B. Accessory buildings to include; Private garage, carport, tool sheds. C. Keeping of not more than four family pets, which can be kept in the home. This limit shall not include birds, fish or suckling young of pets which at all times are kept within the home. D. Community building, recreation buildings and swimming pools, provided they are developed, operated and maintained by a homeowners association. Section 3. One dwelling unit per two thousand two hundred (2,200) square feet Lot area. Section 4. Every lot shall be wide enough and deep enough to meet off-street parking, yard and building code requirements. -------------------- Ordinance No. 3672 Page Two 8-12-81 Section 5. All townhouses and accessory structures shall not cover more than fifty (50%) percent of the lot. Patios, driveways and walkways shall not increase the total lot coverage to more than sixty-five (65%) percent of a lot. Section 6. Every lot shall have open space unobstructed from the ground upward unless otherwise permitted. All measurements are made from the property line to the building line. The street yard set backs shall be from public or private streets. A. Front Yard - 20 Feet. B. Side Street Yard - 10 Feet. C. Side Yard - None required except when side yard abuts private property not •wi.thin, plat, then side yard set back shall be 5 feet. D. Rear Yard - 25 Feet. Section 7. Each dwelling unit'shall have a minimum floor area excluding any area to be used for garage, porch or,similar areas. They are as follows: Lot Size: Minimum Floor Area 2,200 Sq. Ft. 500 Sq. Ft. - One Bedroom 600 Sq. Ft. - Two Bedrooms Section 8. The maximum height of buildings shall be; A. Dwelling Unit - Two and,bne-half stories not to exceed thirty feet in height. B. Accessory Buildings - One story, not to exceed sixteen feet in height. Section 9. Fence and hedge requirements shall be as provided for in Chapter 18.54 and shall pertain to both public and private streets. Section 10. Minimum off-street and loading requirements shall be as provided for in Chapter 18.58. Where on-street parking is restricted due to fire lane requirements on both public and private streets, off-street guest parking spaces shall be provided in an amount equal to one-half space for each dwelling unit fronting on the street having restricted on-street parking. This is in addition to required parking. Section 11. Minimum landscaping shall conform to the requirements provided in Chapter 18.56. Section 12. Property to be developed shall be designed in accordance with the following minimum standards and shall conform to the revised site plan for Skylark dated 8-3-81 on file in the Planning Department. ------------------------- Ordinance No. 3672 Page Three 8-12-81 A. Street Improvement: 1. All through streets serving property beyond the boundaries shall be public streets designed in accordance with the minimum requirements of Chapter 17 of the Auburn City Code (Subdivision Ordinance). 2. Private streets shall be constructed in accordance with the standards established by the Director of Public Works. This shall include the installation of Type "A" or "D" cement concrete curb, asphalt concrete paving, street lighting, etc. ti t 3. Cul-de-sacs shall'be installed at the end of all dead end private streets and shall have a minimum roadway radius of 32.5 feet. No on-street park- ing shall.be allowed,on cul-de-sacs and shall be posted as fire lanes. 4. Minimum roadway widths for private streets shall not be less than thirty (30) feet. 5. No on-street parking shall be allowed on street having a roadway width of less than 34 feet. 6. On roadway where on-street parking is restricted, "No Parking - Fire Lane" signs shall be installed and maintained, as required by the Fire Marshall. 7. Sidewalks shall be installed on at least one side of all private streets. Walkways may be installed that provide direct access to each unit, are functionally and safely convenient to any community facility or recreational areas within the site and to public streets and sidewalks adjacent to the site and are separated from vehicular traffic by curbs. All sidewalks or walkways shall be constructed in accordance with the standards established by the Public Works Department. 8. All public streets abutting or adjoining the site shall be improved to minimum standards for half-streets as established by the Public Works Department. 9. All other public improvements including water mains, fire hydrants, sanitary sewers, storm drainage, etc., shall be installed to the minimum standards as established by the Public Works Department. 10. Groups of townhouses or condominiums with three or more units attached to each other, whether being conveyed or separately shall have at least a five (5) foot variation in the front yard on at least every third unit. Or a five (5) foot extension into the front yard to help provide privacy and identity for each unit. Section 13. The Planning Director of the City of Auburn, Washington, is hereby authorized and directed to file a certified copy of this Ordinance with the King County Auditor. ----------------------- Ordinance No. 3672 Page Four 8-12-81 Section 14. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
