HomeMy WebLinkAbout3675 ORDINANCE NO. 3 6 7 5 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 300, WHICH DISTRICT HAS BEEN CREATED AND ESTABLISHED PROVIDING FOR THE CON- STRUCTION OF AN 8 INCH SANITARY SEWER AND APPURTENANCES ON WESTERN AVE- NUE BETWEEN WEST MAIN STREET AND A POINT APPROXIMATELY 1300 FEET NORTH OF WEST MAIN STREET, INSIDE THE CORPORATE LIMITS OF THE CITY OF AUBURN: AS PROVIDED BY ORDINANCE NO. 3318, OF THE CITY OF AUBURN, AND LEVYING AND ASSESSING THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS, TRACTS, PARCELS OF LAND AND OTHER PROPERTY UPON SAID ROLL. WHEREAS, the assessment roll levying the special assessments against the properties located in the Local Improvement District No. 300 of the City of Auburn, Washington, created under Ordinance No. 3318, has been filed with the City Clerk of the City of Auburn, as provided by law; and WHEREAS, notice of the time and place of hearing thereof and making objections and protests to said roll was duly published at and for the time and in the manner provided by law, fixing the time and place of hearing thereon for the 17th day of August, 1981, at the hour of 8:00 P.M. in the Council Chambers of the Auburn City Hall, Auburn, Washington, and further notice thereof was duly mailed by the City Clerk to each property owner shown on said roll; and WHEREAS, at the time and place fixed and designated in said notice of hearing was duly held, and no protests were filed at said hearing; and WHEREAS, after the hearing was held the assessment roll was accepted as presented and ordered confirmed. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That there is hereby in all respects approved and confirmed the assessments and assessment roll in Local Improvement District No. 300, providing for the construction of an 8 inch sanitary sewer and appurtenances on Western Avenue between West Main Street and a point approximately 1300 feet North of West Main Street, inside the corporate limits of the City of Auburn, according to plans prepared and on file in the office of the City Engineer of the City of Auburn, for the benefit of the following described property: Ordinance No. 3675 Page One 8-19-81 Lunn's Garden Tracts to Auburn as recorded in Volume 10, page 33, records of King County, Was Block "D". Lots 11, West I Lots 12, 13, all Lots 14, 15, 16, 17, and 18. Block "E". Lots 1, 2, 3, 4, 5, 6, 7, and 8. Section 2. That each of the lots and other property upon said assessment roll is hereby declared to be especially benefited by said improvements in at least the amount charged against the same, and that the assessment appearing against each of the same is in proportion to the several assessments appearing on said roll. That all of the property shall be assessed according to the lineal frontage of the property abutting said property to be improved and shall be assessed according to their.proportionate share of the several assessments appearing upon the said assessment roll and there is hereby levied and assessed against such lots and other property appearing upon said roll, the amount finally charged therein against the same; said amount, or any portion thereof, may be paid at any time within thirty (30) days from the date of the first publication of the Notice of Collection of said assessments without penalty, interest or cost; thereafter the sum remaining unpaid, if any, may be paid in ten (10) equal annual installments, with interest on the whole unpaid sum at the rate of seven and one- half percent (7.5%) per annum. Commencing with the first year after the last day, such assessments, or any portion thereof, may be paid without penalty, interest or cost (30 days from the date of the first publication of the Treasurer's Notice of Collection of Assessments) and each year thereafter, one of said installments, together with the interest due, shall be collected as provided by law and the Ordinances of the City of Auburn, assessments or installments of assessments not paid when due shall be delinquent and there shall be added to the same a penalty of five percent (50M) of the amount of the overdue installment and interest, and such penalty shall become a part of the lien upon the property assessed. ------------------------------ Or.dinance No. 3675 Page Two 8-19-81 Section 3. All monies collected by the City Treasurer upon any of the assessments levied, as authorized herein, shall be paid into "Local Improvement District No. 300 Fund" created by Ordinance No. 3318, and shall be used only for the purpose of redeeming warrants and/or bonds drawn upon or issued against said fund. Section 4. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law. I certify that said Ordinance No. 3675 was duly passed by the Council and approved by the Mayor of the said City of Auburn, on the 8th day of September A.D., 19$x. I further certify that said Ordinance No. 3675 was published as provided by law in the Daily Globe News, a daily newspaper published in the City of Auburn, and of general circulation therein, on the 18th day of September A.D., 19 81 .
