THEREFOR. , WHEREAS, a petition has.been filed with the City Council of the City of Auburn, signed by the owners of the property aggregating a majority (1) of the lineal frontage upon the improvement and (2) of the area within tHe proposed district, setting forth the nature and territorial extent of the proposed irn- • provement, the mode.of payment and what proportion of the lineal frontage upon the improJement and of,the area,within.the proposed district is owned 6y the • petitioners as shown by the records in the office of the County Auditor for , King County, Washingtorr,•petitioning for the-construction and installation of. • sanitary'sewer and appurtenances on,6dest Main (southside) between SR-167 and Lund Road and Lund Road from'West Main to a point 1,260 feetrsouth of 41est Main, within the.City,of Au6urn, Washington; and WHEREAS, the City Engineer has caused an estimate to be made on the cost and expense of the'proposed improvement end, has certified said estimates to the , City Council, together with all papers and'.information in his possession touching. " Page One ~ ' • 9-30-81 ' , . . . , ' WHEREAS, said estimatesare accompanied by a diagram of the proposed improvement showing thereon the lots, tracts.and parcels of land and other property which will be especially benefitted by the proposed improvements and the estimated amount of.the cost and expense thereof to be horne by each lot, tract and parcel of land or other property. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY,OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section l. That West Main (south side) between SR-167 and Lund Road and Lund Road from West Main to a point.1,260.feet south of West Main, be improved by the construction and installation of sanitary sewer and appurtenances, all in accordance with plans and specifications.prepared by the City Engineer an•d•. . . ; . filed with the City Clerk. Section 2. Tfiat there is hereby created and•established a LocaT Improvement District to be designated Local Improvement:,District No. 321, which said district t is descri6ed as follows, to-wit: , That portion•of Section 13, Township 21 North, Range 4, East W.M. described as follows: The NW 1/4 of SW 1/4 lying east of SR-167 less N 900•feet of W 402 ft of W 112 less street and highway. The W 2/3 of NE 1/4 of SW 1/4 less street and less North 415 ft, • That por.tion of S 1/2 of Sld 1/4 lying North of SR-18 less East 100 ft and less street. Section 3. That the estimated costs in carrying out the foregoing im- provement is here6y declared to be as near as may be, the sum of $136,888.15. Section 4. Applica6le costs and expenses of all engineering, legal, inspection, advertising, publication and notices, and all other expenses incident thereto, shall be levied and assessed ageinst all of the property legally and properly assessable therefor, as provi'ded 6y the.laws of the State of Idashington and ttie Ordinances of the City of Auburn." ' That'said improvements sfiall be •made 6y the City_of Auburn' ; under the supervision of the.City Council thereof-or svch commi"ttee or person as tfie City Council may designate. Section 6. Assessments or any.portion thereof, may 6e paid at any time within thirty (30) days from the;date of the first publication of the Notice of " Collection of such assessments without penalty, interest; or,costs,•and thereafter the 'sum remaining unpaid, if any, may be paid in ten (1,0)'equal annuaT'.install- , ments, withinterest on.the'whole unpaid sum at the rate,:of orie-half (l/2) of one.percent (1%) in excess,of the net effective rate of the Local Improvement District bonds with the interest in no case being.greater than thirteen percent (13%)• ~ . . , Commencing with the -fi;rst year after the l.ast,day, such assessments, or any portion thereof, may be'paid without penelty, interest or cost (thirty (30) days from the date of the first publication of,the Treasurer's Notice.of Collection of Assessments) and,each*year thereafter one of said'installments, together wi,th ; the:interest due; shall be collected ar provided.by. law.*and the_ Qrdinances of the .
