HomeMy WebLinkAbout3727 ORDINANCE N0. 3 7 2 7 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF A PARCEL OF LAND 40 ACRES IN SIZE LOCATED SOUTHWESTERLY OF KERSEY WAY, WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM UNCLASSIFIED TO R-2 WITH A CONDITIONAL USE PERMIT FOR CLUSTER TYPE HOUSING. , WHEREAS, a petition has been submitted to the Council of the•City of Auburn, Washington; by SKYVIEW ASSOCIATES, requesting the rezoning of the rea} property hereinafter described.in Section 1 of thi"s Ordinance, which,petition was. dated February 25, 1980; and' . , WHEREAS, said request above referred to, was referred to the Planning .Commission by the. Auburn City Council for.study and.public hearing thereon; and WHEREAS, the Planning Commission held a public'hearing to consider said petition in the Council Chambers of the Auburn City Hall, on-April 8, 1980, at 7:30 P.M., at which time the matter`was tabled; and WHEREAS, the Planning Commission held a public hearing to consider said petition in the Council Chambers.of the Auburn City Hall, on June 3, 1980, at the conclusion of which the Planning Commission recommended the approval of the reioning of the said property; and WHEREAS, the City Council of the City of Auburn; held a public hearing in the Council Cfiambers of the Auburn City Hall, at 8:00 P.M. on July 7, 1980, at which time the City Council concurred with the recommendations of the ` 'Planning Commission as hereinabove stated, subject to the preparation of an Environmental Impact Statement. • . ' NOW, THEREFORE, THE CITY_'COUNCIL OF THE CITY.OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the following described property located on a parcel of land 40 acres in size located southwesterly of Kersey Way, situate in the City of Auburn, County of King, State of Washington, be and the same is hereby rezoned from Unclassif.ied to R-2 (Single Family) with a Conditional Use Permit to-wit: Ordinance No. 3727 Page One of Two ' 1-18-82 The W:1/2 of the E 1/2 of the NE 1/4 of Sec 31, Twp 21 N, R 5 EWM City of Auburn,`County of King, State of Washington. AKA Portion of' Tax Cots 1 and 4. Section 2. That the dwelling unit density on the portion of the site • zoned for the Conditional Use Permit shall not exceed six (6) dwelling units per acre. Sectior, 3. That the il.lustrati.ve site`pl.an~designated as "Skyview a~ , . ,..r-, . . , . Planned Residential Development" dated May.13, 1980, be attached to and become a part of this ordinance.'„ . , , . . ' Section 4;. That if.no,construction is started:within two (2) years after the effecfive date of this ordinance, the zoning shall revert back ~to the classification of the property prior to rezoning. Section S. That the amendment to the Comprehensive Zoning Map of the`City of'Auburn, Washington, encompassing this Zoning use classification change, which•amendment is designated as Exhibit "A" hereof, be and the same is hereby approved. . Section 6, That the Planning Director for the City of Auburn, Washington, , is hereby authoriied and-directed to file a. certif.ied copy of this Ordinance ' with tNe King County Auditor. Section 7. This Ordinance shall take effect and be_in force five (5) days , . . from and after.its passage, approval and publication, as provided by law. .
