2 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, ADDING TO TITLE 18 OF THE
CODIfIED ORDINANCES OF THE CITY OF AUBURN (ZONING) SECTIONS
3 PERTAINING TO ADULT MOTION PICTURE.7HEATERS AS DEFINED HEREIN.
¢ THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON,-DO ORDAIN AS FOLLOWS:
5 Section 1. There is herewith added to Title 18 of the Codified Ordinances
6 of the City of Auburn, Washington, the following provisions, to-wit:
7 A. Definitions.
8 1. "Adult Motion Picture Theater": An enclosed building used
9 for presenting motion picture films, video cassettes, cable television, or any
10 other such visual media, distinguished or characterized by an emphasis on
11 matter depicting; describing or.relating to "specific sexual actiVities" or
12 "specified-anatomical areas" as hereinafter defined for observation by patrons
13 therein.
14 2, "Specified Sexual Activities":
15 (a) Human genitals in a state of sexual stimulation
16 or arousa];
17 (b) Acts of "human masturbation, sexual intercourse or
18 , sodomy; 19 (c) Fondling or other erotic touching of human genitals
20 pubic region, buttock or female breast. 21 3. "Specified Anatomical Areas":

(a) Less than completely and.opaquely covered"human
23
genitals, pubic region, buttock, and female
24 breast below a point immediately above the top
,25 of the areola; and
26 . (b) Human male genitals in a discernible turgid state,
27 even if completely and opaquely covered.
28 Section 2.. There is herewith added to Title 18 of the Codified

7 Codified Ordinances of the City of Auburn.
8 2. One (1) mile of any public or private school.
9 3. One thousand (1000') feet of any church or other
10 religious facility or institution..
11 4. One thousand (1000') feet of any public park or
12. recreation facility.
13 B. The distances provided in this section shall be measured by
14 following a straight line, without regard to intervening buildings, from the
15 nearest point of the property parcel upon which the proposed use is to be
16 jocated, to the nearest point of the parcel of property or the land use
17 district boundary line from which the proposed land use is to be separated.
18 Section 3. The Mayor is hereby authorized to implement such
19 administrative procedures as may be necessary to carry out the directions of
20 this legislation.
21 . Section 4. This Ordinance shall take effect and be in force five (5) days
22 from and after its •
passage, approval and publication, as provided by law.
