2 AN ORDINANCE OF THE CITY OF AUBURN; WASHINGTON, APPROVING AND CONFIRMING THE
3 ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT N0. 314,
WHICH DISTRICT HAS BEEN CREATED AND ESTABLISHED PROVIDING FOR THE
4 CONSTRUCTION AND INSTALLATION OF SANITARY SEWERS IN THE AREA Of WEST
• VALLEY HIGHWIIY SOUTH OF WEST MAIN STREET, INSIDE THE CORPORATE LIMITS OF
, 5 •THE CITY OF AUBURN AS PROVIDED BY ORDINANCE N0. 3561, OF THE CITY OF
AUBURN, AND LEIIYING AND ASSESSING THE AMOUNT THEREOF AGAINST THE SEVERAL
g LOTS, TRACTS; PARCELS OF LAND AND OTHER PROPERTY UPON SAID ROLL.

WHEREAS, the assessment roll levying the special assessment against the

properties located.in the Local Improvement District No..314 of the City of

Auburn, Washington, created under Ordinance No. 3561,,has been filed with the

City Clerk of the City of Auburn, as provided,by law; and

WHEREAS, notice of the time and place of hearing thereof and making objec-

tions and'protests'.to said roll was duly published at and for the time"and in

the manner provided.by ;law, fixing the.time and place of fiearing thereon for

the 15th,day of March, -1982, at the:hour of 8:00 P.M. in the Council Chambers

of the Auburn City'Ha}1, Auburn, Washington,`and further notice thereof was

duly mailed by the City Clerk to each property owner shown on said roll; and

WHEREAS, at the time and.place fixed and designated in said notice of
18 .
19 hearing was duly.held, one protest was duly filed at said hearing; and
WHEREAS, after the hearing was held the assessment roll was accepted as pre-
20
21 sented and ordered confirmed. 22 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHIN6TON, D0
23 ORDAIN AS FOLLOWS: '

24 Section 1. That there is hereby in all respects approved and confirmed %
25 the assessments and assessment roll in Local Improvement District No. 314,
26 providing for theconstruction and installation of sanitary sewers in the area
, 27 of West*Valley Highway South of West Main Street, inside the corporate limits
28 of the City of Auburn, according to plans prepared and,on fi•le in the Office
29 of the City Engineer of the City of Auburn, for the benefit of the following
30 described property:

1 That portion of the SE 1/4 of Sec 14, Twp 21 N, R 4, EWM, desc as follows:
2 That portion of tlie;east one-half.of,the SE 1/4 said Sec 14, lying east of
3 the West Val•ley`Highway and westerly of SR 167.
4 The North 310 feet of.,that,portion of the NE 1/4 of the SE 1/4 of said

7 Section 2.'. That each of the lots and other property upon said assessment
8 roll is hereby declared to be especially benefited by said improvements in at
9. least the amount charged against the same, and that the assessment appearing
10 against each of the same is in proportion to the several assessments appearing
11 on said roll. That all of the property shall be assessed according to the
12 lineal. frontage of the property abutting said property to be improved and
13 shall be assessed according to their proportionate share of the several.
14 assessments appearing upon the said assessment roll and there is hereby levied
15 and assessed against such lots and other property appearing upon said roll,
16 the amount finally charged therein against tFie same; said amount, or any por-
17 tion thereof, may be paid at any time within thirty (30) days from the date of
18 the first publication of the Notice of Collection of said assessments without
19 penalty, interest or cost; thereafter the sum remaining unpaid, if any, may be
20 paid in ten (10) equal annual installments, with interest on the whole unpaid
21 sum at the rate of one-half (Z) of one percent (1%) in excess of the net
22 effective rate of the Local Improvement District Bonds with the interest in no
23 case being greater than thirteen percent (13%).
24 Commencing with the first year after the last day, such assessments, or
25 any portion thereof, may be paid without penalty, interest or cost (30 days
26 from the date of the first publication of the Treasurer's Notice of Collection
27 of Assessments) and each
year thereafter, one of said installments, together
28 with the interest due shall be collected as
, provided by law and the Ordinance
29 of the City of Auburn, assessments or installments of assessments not paid
30 When due shall be delinquent and there shall'be added to the same a penalty of

eight and one-half percent (8.5%) of the amount of the overdue installment and

Section 3. All monies collected by the City Treasurer upon any of the
5
assessments levied, as authorized herein, shall be paid into ":Local
6
Improvement District No. 314 Fund" created by Ordinance No. 3561, and shall be
7 .
used only for the purpose of redeemi,ng warrants and/or bonds drawn upon or
8 issued against said fund.
9 .
Section 4.. The Mayor is hereby authorized to implement such administra-
10
tive procedures as may be necessary to carry out the directions of this
11
' legislation.

13 Section 5. Th,is Ordinance shall take ef.fect and be in force five (5) tlays
from and after its passage, approval and publication, as provided by law.
