AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, APPROVING AND CONFIRMING THE
3 ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT N0. 3181
WHICH DISTRICT HAS BEEN CREATED AND ESTABLISHED PROVIDING FOR THE
¢ CONSTRUCTION AND INSTALLATION OF Si1NITARY SEWERS IN THE AREA OF 37TH
STREET N.E. AND N.W. BETWEEN "C" STREET N.E. AND THE WEST LINE OF THE
5 PUGET POWER RIGHT OF. WAY LYIN6 WEST OF THE CHICAGO MILWAUKEE RAILROAD
RIGHT OFWAY, INSIDE THE CORPORATE LIMITS OF THE CITY OF AUBURN AS
6 PROVIDED BY ORDINANCE N0. 3587, OF THE CITY OF AUBURN, AND LEVYING AND
ASSESSING THE AMOUNT THEREOF A6AINST THE SEVERAL LOTS, TRACTS, PARCELS OF
7 LAND AND OTHER PROPERTY UPON SAID ROLL.
8 WHEREAS, the assessment roll levying the special assessment against the
9 properties located in the Local Improvement District'No. 318 of the City of
10 Auburn, Washington, created under Ordinance No. 3587; has been filed with the
11 City Clerk of the City of Auburn, as provided by law; and
12 , WHEREAS, notice of the time and place of hearing thereof and making objec-
13 tions and,protests to said roll was duly published at and for the time and in
.
14 the manner provided by law, fixing the time and place of hearing thereon for
15 the 15th day of March, 1982, at the hour of 8:00 P.M. in the Council Chambers
. 16 of the Auburn City Hall, Auburn, Washington, and further notice thereof was
17 duly mailed by the City Clerk to each property owner shown on said roll; and
18 WHEREAS, at the time.and place fixed and designated in said notice of
19' hearing was duly held, one protest was duly filed at said hearing; and
20 WHEREAS,.after the hearing was held the assessment roll was accepted as
21, presented~and~ordered confirmed.
22 NOW; THEREFORE,"THE CITY COUNCIC'OF`THE CITY OF AUBURN, WASHINGTON, DO

24 Section 1. That there is hereby in all respects approved and confirmed
25 the assessments and assessment roll in.Local Improvement District No. 318,
26 .
providing for the construction and installation of sanitary sewers in the area
27 of 37th Street N.E. and N.W. between "C" Street N.E. and the west line of the
28. Puget Power right of way lying west of the Chicago Milwaukee Railroad right of
29
way, inside the corporate limits of the City of Auburn, according to plans
30 Prepared and on file in the Office of the City Engineer of the City of Auburn,

for the benefit,of the described property on attached Exhibit "A".

1 Section 2.-1 That each of the lots and'other property upon said assessment
2 roll is hereby declared to be especially benefited by said improvements in at
. .
3 least the`amount;charged agains. t tfie same, and that the assessment appearing
4 against each of the same is in proportion to the several assessments appearing
5 on said roll. That all of the property shall 6e.assessed according to the
6 lineal frontage of the property abutting said property to be improved and
ry shall be assessed according to their proportionate share of the several
g assessments appearing upon the saiA assessment roll and there is hereby levied
g and assessed against such lots and other proper,ty appearing upon said roll,
10 the amount finally charged therein against the same; said amount, or any por-
• 11 tion thereof, may be paid at any time within thirty (30) days from the date of
12 the first publication of the Notice of Collection of said assessments without
13 penalty, interest or cost; thereafter the sum remairiing unpaid, if any, may be'
14 paid in ten (10) equal annual installments, with interest on the whole unpaid
15 sum at the rate of one-half (2) of one percent (1%) in excess of the net
16 effective rate of the Local Improvement District Bonds with the interest in no
17 case tieing greater than thirteen percent (13%).
18 Commencing with the first year after the last day, such assessments, or
19 any portion thereof, may be paid without penalty, interest or cost (30 days
20 from the date of the first publication of the Treasurer's Notice of Collection
21 of Assessments) and each year thereafter, one of said installments, together
22 with the interest due, shall be collected as provided by law and the Ordinance
23 of the City of Auburn, assessments or installments of assessments not paid
24 when due shall be delinquent and there shall be added to the same a penalty of
25 eight and.one-half percent (8.5%) of the amount of the overdue iristallment and
26 interest,and such penalty shall become a part of the lien upon the property
27 assessed.
' 28 Section 3.; All monies collected by the City Treasurer upon any of the
29 as'sessments-levied, as authorized herein, shall be paid 9nto "Local
30 Improvement District No. 318 Fund" created by Ordinance No. 3587, and shall be

. 2 used.only for the purpose of redeeming:warrants and/or.bonds drawn upon or
3- issued against said fund. .
• 4 Section 4. The Mayor'is.hereby authorized'to implement such administra-
5 tive procedures as may be.necessary to carry out.the, directions.of this
. 6 legislation. .
7 'Section 5. ;This Ordinance shall take-effect and be in force five (5) days
8 from and after its passage, approval and publication, as-provided bylaw.
