Y '1 . . . l ORDINANCE N0: 3 7 4 6 2 ~ ~Y AN ORDINANCE OF'THE CITY'OF AUBURN, WASHINGTON, APPROVING AND CONFIRMING THE 3 ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT N0. 313, WHICH DISTRICT HA$ BEEN CREATED AND ESTABLISHED PROVIDING FOR THE 4 CONS1'RUCTION AND INSTALLATION OF STREET IMPROVEMENTS AND WATER MAINS ON "C" STREET N.W. FROM A POINT 400 FEET NORTH OF 6TH STREET N.W. TO 15TH 5 STREET N.W., INSIDE THE CORPORATE LIMITS OF THE CITY OF AUBURN AS PROVIDED ' BY ORDINANCE N0. 3568, OF THE CITY OF AUBURN, AND LEVYIN6 AND ASSESSING 6 THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS, TRACTS, PARCELS OF CAND AND OTHER PROPERTY UPON SAID ROLL. ry 8 WHEREAS, the assessment roll. levying the special assessment against the 9 properties located in the Local Improvement District No. 313 of the City of 10 Auburn, Washington, created under Ordinance No. 3568, has been filed with the 11 City Clerk of the City of Auburn, as provided by law; and 12 WHEREAS, notice of the time and place of hearing thereof and making objec- 13 tions and protests to said roll was duly published at and for the time and in 14 the manner provided by law, fixing the time and place of hearing thereon for 15 the 19th day of April, 1982, at.the hour of 8:00 P.M. in the Council Chambers 16 of the Auburn City.Hall, Auburn, Washington, and further notice thereof was 17 duly mailed by the City Clerk to each property owner shown on said roll; and 18 WHEREAS, at the time and place fixed and designated in said notice of 19 hearing was duly held, no protests were duly filed at said hearing; and . 20 WHEREAS; after the hearing was held the assessment roll was accepted as pre- 21 sented and ordered confirmed. 22 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,.WASHINGTON, DO 23 ORDAIN AS FOLLOWS: , 24 Section 1. That there is hereby in all respects approved and confirmed 25 the assessments and assessment roll in Local Improvement District No. 313, 26 providing for the construction and installation of street improvements and 27 water mains on "C" Street.N.W. from a point 400 feet north of 6th Street N.W. , 28 to 15th Street N.W.,..insi'de the corporate limits of the City of Auburn, 29 accordin to lans g p prepared and on file in the Office of the City Engineer of " 30 the City of Auburn, for the benefit of the following described property: 31 32 Ordinance No. 3746 Page One of~Three 4-13-82. , > . • + • _ , , . . . That~each of the lots and other property upon said as'sessment . 10 roll is hereby declared to be especially benefited by said improvements in at 11 least the amount charged against the same, and that the assessment appearing 12 against each of .the same is.in proportion to the several assessments appearing 13 on said roll. That all of the property`shall be assessed according to the 14 lineal frontage ofthe property 'abutting said property .to be improved and , , ~ 15 shall be assessed according to their proportionate share of the several ` 16 assessments appea'ring upon tlie said assessment roll and there.is hereby levied , ,17 and assessed against such lots and other property appearing upon said roll, lg the amount finally charged therein against the same; said amount, or any por- 19 tion thereof, ma,y be paid at any time within thirty (30) days from the date of 20 the first publication of the Notice of Co]lection of said assessments without 21 penalty, interest or cost; thereafter the sum remaining unpaid, if any, may be 22 paid in ten (10) equal annual installments, with interest on the whole unpaid 23 sum at the rate of one-half (Z) of one percent (1%) in excess of the net 24 effective rateof the Local Improvement District Bonds with the interest in no 25 case being greater than thirteen percent (13%). 26 Commencing'with the first year after the last day, such assessments, or 27 any portion thereof, may be paid without penalty, interest or cost (30 days 28 from the date of the first publicatiori of the Treasurer's Notice of Collection 29 of Assessments) and each year thereafte"r, one of said installments, together 30 with the interest due, shall be collected as provided by law and the Ordinance 31 of the City of Auburn, assessments or installments of assessments not paid 32 Ordinance No. 3746 Page Two of Thr,ee 4-13-82 . , . . • . .
