CITY OF AUBURN, a municipal corporation of King County, State of Washington, hereinafter termed
"Grantee", and Darrel R. Merritt and Sheila I. Merritt, husband and wife, and Gary A. Merrit and
M. Jean Merritt, also appearing of record as M. Jeanie Merritt, husband and wife, "Grantor".

WITNE S SETH:
The Grantor does hereby grant unto the Grantee and its authorized agents a temporary right-of-way or
easement to be used only during construction of public roadway widening, sidewalks, utilities, traffic
signalization and related work on adjacent property, said temporary easement shall terminate upon
completion and acceptance from the City of Auburn, a municipal corporation, or on January 1, 1997,
whichever come first. The said temporary right-of-way or easement shall be through and across the
following described property situated in King County, Washington, more particularly described as
follows:
The Easterly 70 feet of the Westerly 127 feet of that portion of the John M. Thomas Donation
Claim No. 42, being in Section 36, Township 22 North, Range 4 East, W.M., lying South of a
line 45 feet North of as measured perpendicular to, the centerline of South 277th Street and
lying West of State Route 167;
EXCEPT any portion thereof lying within the West 57 feet of said John M, Thomas Donation
Claim No. 42;
ALSO EXCEPT any portion lying within South 277th Street.

The City of Auburn will provide a 35 foot wide curb and gutter driveway, per King County
Road Standard Drawing No. 3-004. Driveway location is shown on Exhibit "A" attached
hereto and incorporated herein.
