HomeMy WebLinkAbout8010311183 STORM WATER EASEMENT 103180A C y0 EASEMENT THIS AGREEMENT made this ,2' AO day of 19 90, by and between CITY OF AUBURN, a municipal corporation in King County, Washington, hereinafter termed "Grantee," and IIAGG,-GY &siv4?rm9 AA ex- , A ,/iFSN1ft tro~n/ hereinafter termed "Grantor":L WITNESSETH: That the said Grantor for valuable consideration does by thes.e presents grant unto the Grantee a perpetual right-of-way or easement for a storm drain force main pipeline with the necessary appurtenances through, over and across co that certain real property described on Exhibit "A", attached hereto and by this reference.incorporated herein as fully set forth. Said Grantee shall have the right without prior institution of any suit C'3 or proceeding at law, at such times as may be necessary to enter upon said CD easement for the purpose of constructing, maintaining, repairing, altering or co reconstructing said storm drain force main pipeline, or making any connections therewith, without incurring any legal obligation or liability therefor, providing that such shall be accomplished in a manner that existing private improvements shall not be disturbed or destroyed, or in the event that they are disturbed or destroyed, that they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. Grantor shall retain the right to use the surface of said easement if such use does not interfere with installation or maintenance of the storm drain force main pipeline. However, the Grantor shall not erect buildings or structures on the easement. This easement shall be a covenant running with the land and shall be binding on the successors, heirs, and assigns of both parties hereto. At the time of construction of the P-7 drainage channel, this instrument shall become null and void. Lot 1 of Auburn Short Plat No. 27-78 as recorded under King County Auditor's File No. AUB-7810190517 in •S;ection 36, Township 22-North, Range 4 East, Willamette Meridian, King County, Washington, will have the right to use the storm drainage detention system located within the Puget Sound Business Park. 1% F!"XISE TAX NOT REQUIRED A Ring Co.
