grant and convey to the City of Auburn, a municipal corporation, s slope.easament
over and across, upon and underneath, the following described land for cuts and

North 5 feet of the West 122.02 feet of Lot 4, Block 3, of sd Christopher
Garden Tracts. And ,also the North 5 feet of the East 132.98 feet of Lot 3,
Block.3, of sd Christopher Garden Tracts. And also the North $ feet of
the West 219.81 feet of Lot 2, Block 3, of sd Christopher Garden Tracts.
And also the North S feet of the East 142.02 feet of Lot 1, Block 3, of
sd Christopher Garden Tracts. And also the North 10 feet of the West
n 220 feet of Lot 1, Block'3,'of sd-'Christopher Garden Tracts.
Said Grantee shall have the right without prior institution of any suit or i
proceeding at law, at times as may be necessary, to enter upon said easement for i
the purpose of construction roadway improvements without incurring any legal
oblication or liability therefor; provided that such construction shall be
accomplished In such a manner that private Improvements shall not be disturbed
or destroyed, or in the event they are disturbed or destroyed, they will be
replaced in as good a condition as they were immediately before the property
was entered upon by the Grantee.
This easement shall be a covenant running with the land and shall be
binding on the successors, heirs,and assigns of both parties hereto.
