grant and convey to the City of Auburn, a municipal corporation, a slope.easement
over and scross, upon and underneath, the following described land for cuts and
fiils as may be required In the construction of
37th Street N.W.
said land being described as: The North 5 feet of the South 352 feet of the North
382 feet of the West 1/2 of the West 371.25 feet of the East 636.25 feet of the
SW 1/4 of the NE 1/4 of ~Secfion 1") Twp. 21 North, Range 5 East, W.M.
Said Grantee shall have the right without prior Institution of any suit or
proceeding at low, at times as may be necessary, to enter upon said easement for
q the purpoae_of_construction.roadway improvements without Incurring any legal
:obl Icat Ion or 1-1-abi l`ity therefor; -provi=ded that-,such .construction shat I be
accomplished in such a manner that private Improvements shall not be disturbed
or destroyed, or in the event they are disturbed or destroyed, they will be
replaced in as good a condition as they were immedlately before the property
was entered upon by the Grantee.
This easement shall be a covenant running with the land and shall be
binding on the successors, heirs,and assigns of both parties hereto.
