E A S E M E N T
i"Com ntortfand PARK COMPANY, a Minnesota corporation, hereinafter
callany"in consideration of One Thousand Dollars ($1,000.00)
to it paid, and the agreements herein contained, does hereby grant to the CITY
OF AUBURN, a municipal corporation in the State of Washington, hereinafter
called "City", an easement for sanitary sewer line purposes only, over and
upon the following described premises situated in the County of King, State
of Washington, to-wit:
Those portions of Lots 1, 2, 3 and 4, Block 3, of the
Plat of Christopher Garden Tracts as recorded in Volume
23 of Plats, Page,'°6, records of said King County,
Washington, shown by red color on the Exhibit "A"
print dated March 5, 1981 attached hereto and by
this reference made a part hereof.

The Company, for itself and its successors and assigns, reserves all
rights to use the,property hereinbefore described for any and all purposes
whatsoever not inconsistent with the easement hereby granted, including, but
not limited to, the right to construct, maintain, repair, renew, reconstruct,
replace and operate present tracks and future tracks, communication, signal
and electric power lines, utilities, access roadways, and other types of
facilities on said property when deemed necessary or expedient to the
Company. Rights reserved shall be so exercised as not to damage or
interfere with the sewer.line as above defined. This easement is
subject to all existing interests of third parties in said property
of any kind or nature whatsoever and any and all extensions or renewals
thereof.

Insofar as the City may be authorized so to do from time to time under
the laws of the State of Washington, the City will protect, save and hold
harmless the Company from all claims, costs, damage or expense of any nature
whatsoever, including attorney fees, arising out of, in connection with or
incident to activities conducted on the premises of the Company pursuant to
the easement, excepting only such claims, costs, damage or expense which may
be caused by the sole negligence of the Company.

In the event that said property shall at any time cease to be used for
sanitary sewer line purposes, or shall by operation of law or otherwise become
vacated or abandoned, the easement herein granted shall immediately cease and
terminate without notice or other proceedings on the part of the Company, and
the City, its successors or assigns, shall reconvey immediately said property
to the Company.
IN WITNESS WHEREOF, the parties hereto have executed this agreement in
duplicate this : sth day of June , 1981 .
