gran and convey to the City of Auburn, a municipal corporation, a slope ease-
ment over and across, upon and underneath, the following described land for cuts
and fills, as may be required in the construction of
West Valley Highway North ,
said land being described as:
THAT PORTION OF THE SOUTH ONE-HALF OF THE NORTHEAST ONE-QUARTER OF THE SOUTHEAST
ONE-QUARTER OF THE SOUTHEAST ONE-QUARTER OF~E CTION _2,)TOWNSHIP 21 NORTH, RANGE
4 EAST, W.M. DESCRIBED AS FOLLOWS:
A 10.00 FT. STRIP OF LAND THE EASTERLY BOUNDARY OF WHICH ABUTS AND ADJOINS THE
WESTERLY BOUNDARY OF THE WEST VALLEY HIGHWAY, AKA S.S.H. NO. 5-M, AKA 68TH AVENUE
SOUTH.
N THE NORTHERLY BOUNDARY OF SAID STRIP OF LAND ABUTTING AND ADJOINING THE EAST
BOUNDARY OF SAID SECTION 2. THE SOUTH BOUNDARY OF SAID STRIP OF LAND ABUTTING AND

THIS SLOPE EASEMENT SHALL TERMINATE WHEN THE ABUTTING PRIVATE PROPERTY IS FILLED
TO MATCH THE EXISTING WEST VALLEY HIGHWAY GRADES.

Said Grantee shall have the right, without prior institution of any suit or
proceeding at law, at times as may be necessary, to enter upon said easement for
the purpose of constructing roadway improvements without incurring any legal
obligation or liability therefor; provided that such construction shall be
accomplished in such a manner that private improvements shall not be disturbed
or destroyed, or in the event they are disturbed or destroyed, they will be
replaced in as good a condition as they were immediately before the property was
entered upon by the Grantee.
This Easement shall be a covenant running with the land and shall be
binding on the successors, heirs and assigns of all parties hereto.
