Commencing at the.intersection of the South line of the said SE 1/4 with the Easterly margin of Frontage Road as delineated on that certain.Washington State. Highway Commission.right-of-way drawing SR 167 MP13.66 to MP17.42, AUBURN : 17th SW to S. 285th St., sheet 7 of'30 sheets, bearing date of approval June 12, 1969 and revised Sep- 'tember 251 1969; thence'Northerly along said Easterly margin 250.00 feet to the Point of Beginning; thence Easterly at right angles to said Easterly margin 1,145 feet more or less to the said Westerly mar- gin of the Puget Sound Electric R.Y. Right of Way and the terminus of said line' description; also That portion.of the said SE 11/4 lying Westerly of the Easterly. 418.+feet.thereof included within the limits of a strip of land 10 feet in.width.the Northerly margin of which is the same as the line described above. On, puty EASEMENT NO. 79-1-2R r a 4 That portion of the said SE 1/4 lying Westerly of,the Easterly 433 feet thereof included within the limits of a strip of land 25 feet in width the Northerly margin of which is the same as the lime described above. ~7l Q N (t~ Said temporary construction easement shall remain in force during construction and until such time as the sewers and.appur- tenances have been accepted for maintenance and operation by the City of Auburn. -2- EASEMENT NO. 79-1-2R That said Grantee shall have the right.without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said prope'rty'for the purpose of constructing, repairing, altering, or reconstructing said Sewer Main, or making any connections therewith, without incurring any legal obligation or liability there- for; provided that such constructing, repairing, altering, or recon- structing of said Sewer Main shall be accomplished in such a manner that the private improvements existing in this right-of-way shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. C) t C) (0 C3 The Grantor shall retain the right to use the surface of said easement, so long as said use does not interfere with the installation and maintenance of the.Sewer Main and so long as no permanent buildings or.structures are erected on said easement. .This.easement-shall be a covenant running with the land and shall be binding on the successors, heirs, and assigns of both parties hereto.
