WITNESSETH:
C") That the said Grantor for valuable consideration does by these
C? presents grant unto the Grantee a perpetual right-of-way or easement
for sewer mains with the necessary appurtenances through, over and
CNJ across the following described property situated in King County,
~ Washington.
The West 20 feet of the East.418 feet of that portion of the
SE 1/4 of the SW 1/4 of'-Section 1, Township 21 North, Range 4 East,
W.M., lying Westerly of the-Westerly margin of the Puget Sound Elec-
tric R.Y. Right of Way, lying Southerly of the North .35 feet of the
said SE 1/4,.,and lying Northerly of the following described line;
Commencing at the intersection of the South line of the said SE 1/4
with the Easterly margin of Frontage Road as delineated on that cer-
tain Washington State Highway Commission right-of-way drawing SR 167
MP13.66 to MP17.42, AUBURN: 17th SW to S. 285th St., sheet 7 of 30
sheets, bearing date of approval June 12, 1969 and revised September
25, 1969; thence Northerly along said Easterly margin 250.00 feet to
the Point of Beginning; thence Easterly at right angles to said East-
erly margin 1,145 feet more or less to the said Westerly margin of
the Puget Sound Electric R.Y. Right of Way and the terminus of said
line description; also
That portion of the said SE 1/4 lying Westerly of the Easterly
418 feet thereof included within the limits of a strip of land 10
feet in width the Southerly.margin of which is the same as the line
-described above; also
The South 20 feet of the North 55 feet of the East 398 feet of
that portion of the said SE 1/4 lying Westerly of the said Westerly
margin of the Puget Sound Electric R.Y. Right of Way; also
The South 15 feet of the North 35 feet of the west 20 feet of
the East 52.5 feet of that portion of the said SE 1/4 lying Westerly
of the said Westerly margin of the Puget Sound Electric R.Y. Right
of Way.

That said Grantee shall have the right without prior institution
of any suit or proceeding at law, at times as may be necessary, to
enter upon said property for the purpose of constructing, repairing,
altering, or reconstructing said Sewer Main, or making any connections
therewith, without incurring any legal obligation or liability there-
for; provided that such constructing, repairing, altering, or recon-
structing of said Sewer Main shall be accomplished in such a manner
that the private improvements existing in this right-of-way shall not
be disturbed or destroyed, or in the event they are disturbed or
destroyed, they will be replaced in as good a condition as they were
immediately before the property was entered upon by the Grantee.
The Grantor shall retain the right to use the surface of said
easement, so long as said use does not interfere with the installation
and maintenance of the Sewer Main and so long as no permanent buildings
or structures are erected on said easement.
This easement shall be a covenant running with the land and
shall be binding on the successors, heirs, and assigns of both parties
hereto.

the West 50 feet of the East 433 feet of that portion of the said SE
1/4 lying Westerly of the said Westerly margin of the Puget Sound
Electric R.Y. Right of Way; also
That portion of the said SE 1/4 lying Westerly of the Easterly
433 feet thereof included within the limits of a strip of land 25
feet in width the Southerly margin of which is the same as the line
described above; also
The South 50 feet of the North 70 feet of-the East 383 feet of
that portion of the said SE 1/4 lying Westerly of the said Westerly
margin of the Puget Sound Electric R.Y. Right of Way.

Said temporary construction easement shall remain in force
during construction and until such time as the sewers and appur-
tenances have been accepted for maintenance and operation by the
City of Auburn.

CONSTRUCTION EASEMENT

CITY OF AUBURN, a municipal corporation of King County, State of Washington, herein-
after termed "GRANTEE" and ED1 T,H M,'?PO,ORTVLI£T, Executor for the Estate of George J.
Poortvliet
hereinafter termed "GRANTOR".
WITNESSETH:
The Grantor does hereby grant unto the Grantee and its authorized agents a
temporary right-of-way or easement to be used only during construction of the Valley
Freeway (S.R. 167) and 37th Street N.W.. Said temporary easement shall terminate
upon acceptance of the street for maintenance and operation by the Grantee. It is
further understood that the Washington State Highway Department will restore said
easement to its original condition.,-..._The said temporary right-of-way or easement
shall be through and across the following described property situated in King County,
Washington, more particularly described as follows:
All that part of the following described Tract "Z" lying within a strip of land
15 feet in width lying Northerly of; adjacent to and parallel with the follow-
ing described line. Begin at a point 65 feet distant Northerly when measured
at right angles from the 37th Street. N.W. center line survey of S.R. 167 Auburn:
17th Street S.W. to South 285th Street at Highway Engineers Station 6+80 (here-
inafter referred to as H.E.S.); thence Easterly in a straight line to a point
95 feet distant Northerly when measured at right angles from said center line
at H.E.S. 10+00 and end of this line description.
EXCEPT that portion thereof lying Westerly of a point on said line opposite
H.E.5. 7+55 of said survey line.
TRACT "Z": That portion of--TraCt._"-I"-of_Town of Christopher,`,as per plat record-
ed in Volume 7 of Plats, on Page.30, records of King County lying West of a line
683.4 feet West of and parallel to the East line of said tract, TOGETHER WITH
vacated Rose Street adjoining on the North; EXCEPT the Westerly 30 feet hereto-
fore conveyed to King County by deed dated May 13, 1910, and filed for record on
May 21, 1910, and recorded in Volume 746 of Deeds, Page 571, under Auditor's
File No. 694374 for road purposes; AND EXCEPT the following described tract:
Beginning at the intersection of the South line of said Tract "I" with the East
line of Pacific Highway; thence North along said East line of Pacific Highway
100 feet; thence East 100 feet; thence'South 100 feet; thence West 100 feet to
the point of beginning. Situate in the City of Auburn, County of King, State
of Washington.
