consideration, receipt of which is hereby acknowledged, and for benefits to be derived by the
Grantor herein, Granto,,X. re I, LLC, a Washington limited liability company, as the

and warrants to the City of Auburn, Grantee herein, a municipal corporation of King County,
Washington, its successors and assigns, a perpetual Nonexclusive Easement under, over, through
and across the following described real property for the purpose of laying, maintaining, and
installing storm water drainage line AND APPURTENANCES THEREOF, said real property
being described as follows:
SEE EXHIBIT "A", ATTACHED HERETO AND BY THIS REFERENCE MADE A
PART HEREOF.
This easement is given under the threat of and in lieu of Eminent Domain.
Said Grantee shall have the absolute right, at times as may be necessary, for immediate entry
upon said Easement for the purpose of maintenance, inspection, construction, repair or
reconstruction of the above improvements without incurring any legal obligation or liability
therefore. Except Grantee shall restore to previous condition to the extent
reasonably possible at Grantee's expense.

Said Grantee shall have the absolute right to place any type of driving surface within said
Easement deemed necessary by the Grantee.
Said Grantor shall not in any way block, restrict or impede access and egress to or from said
Easement, and/or in any way block, restrict or impede full use of the real property within the
above-described Easement by said Grantee for the above-described purposes. Said Grantor may
m fence across said Easement and/or along the boundaries of said Easement provided that a gate is
r constructed in said fence: Said gate shall be of sufficient length and location to allow the Grantee
full use of, and access 'arid egress to' and from the real property within the above-described
Easement. If said gate is to be locked, keys shall be provided to the Grantee.

PUBLIC STORM DRAINAGE EASEMENT
Portions of King County Tax Lot No. 000080-0044 & Tax Lot No. 000080-004-5
All that certain real property situate in the City of Auburn, King County, State of Washington,
being portions of Lot C and Lot D of City of Auburn Lot Line Adjustment No. LLA-0019-98,
recorded under King County Recording No. 9810282768, and being a portion of the
J. A. Lake Donation Land Claim No. 41 and Claim No. 38 in the Northeast Quarter of the
Northeast Quarter of Section 12, Township 21 North, Range 4 East, and the Northwest Quarter
of the Northwest Quarter of Section 7, and the Southwest Quarter of the Southwest Quarter of
Section 6, Township 21 North, Range 5 East, Willamette Meridian, described as follows:
An EASEMENT, for public storm drainage purposes, appurtenances thereto and maintenance
thereof, in, on, over, under, through, and across uniform strips-of-land 20.00 Feet in width,
10.00 feet on both sides of the centerlines described as follows:
Commencing at the Northeast corner of said Lot D of Auburn LLA-0019-98, Thence, along the
North line of Lot D, North 88049'52" West 10.00 feet, to the TRUE POINT OF BEGINNING of the
centerline of the herein-described 20.00 foot wide Easement; THENCE, along the centerline the
following courses:
1) South 00°51'25" West 832.30 feet, parallel with and 10.00 feet West
from the East line of said Lot 0, to Point "A
2) North 68049'52" West 380.77 feet, parallel with and 30.00 feet North
from the South line of said Lot D;
3) South 88014'48" West 260.43 feet;
4) South 01 011'21 " West 16.72 feet to a point on the South line of Lot C of
Auburn LLA-0019-98 South 88°49'52" East 534.84 feet from the Southwest corner of Lot C.
