Warren hereinafter termed "Grantor". WITNESSETH: in That the Grantor, for and in consideration of one and no one hundred dollars N ($1.00) does hereby grant unto the Grantee and its authorized agents a planting O area easement on the following described property; said easement to be employed .D for the cons_tr_uction-and-maintenance-of - two- (2) -circul-ar- planting areas which tD shall be not greater than six (6) feet in diameter: The Planting Area easement is described as follows: The East seven feet of the following described property lying parallel with the West marginal line of PSH #5: The E.120' thereof of the N1/2 of the E 250' of the foll. desc. prop: Beg at a pt 30' Wly of the c/1 of Prim. State Hwy..#5 691.20' S of the N line of the S 1/2 of H.H. Jones Don. Land Claim #39, sit in Sec 6, Twp 21 N,.R5 East, W.M.; th S 89017'20" W 496.941; th S 0°55'30" E'12-55.65-1'; th N 89°8'45" E 497.11' alg the N marg of the Transmission Line Easement; th NO°57'30" W 298.35' parallel with & 301'W1y of the c/1 of Prim. State Hwy. #5 to the point of beg. LESS the E 5' thereof for streets. That said Grantee shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said easement for the purpose of construction and maintenance of landscape improvements including necessary cuts and fills without incurring any legal obligation or liability therefor; provided that such construction shall be accomplished in such a manner that private property improvements shall not be disturbed or destroyed, or in the event they are destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the°"G'ra ke. This easement shall be covenant running with the land and shall be binding on the successors, heirs, and assigns of both parties hereto.
