0i and across, upon and underneath, the following described land for ingress and egress
OD and for the purpose of laying, maintaining, and installing a public sanitary
sewer -
said land being described as:
DEED IN GRANT OF SEWER EASEMENT
1) Deed made November 7, 1980 by HITCO, a California Corporation,
with offices at 3016 Auburn Way North, Grantor to the City of
Auburn, State of Washington, Grantee.
2) Grantor, in consideration of one dollar ($1.00) and other
valuable consideration paid by Grantee, the receipt of which
is herein acknowledged, grants to Grantee the right to
construct, alter and maintain a sewer line and all necessary
laterals thereto across the property described as:
The North 30 feet of the South 157.6 feet to
Parcel "A" of City of Auburn Street Plat No.
SP-2-80 as recorded under King County Auditors
File #8003260873, being a portion.of the
William Brannan Donation Claim #37, in~;Section 6,
Township 21 N., Range.5, East W. M. King County,
Washington.
together with the free right of ingress and egress over and
across such property insofar as such right of ingress and
egress is necessary to the proper use of any other right
granted herein, upon the conditions that Grantee at all times
will restore to its prior condition any fence removal, land-
scaping, or other damage resulting from Grantee's exercising
its right of ingress or egress granted herein.

THIS AGREEMENT made this _y_ day of 19891
by and between the City of Auburn, a municipal corporation of King
County, Washington, hereinafter termed "Grantee" and
Arthur L. Kleppen and James L. Conley and
Joyce M. Kleppen and Frances Conle his wife
herina ter termed 'Grantor'.
WITNESSETH:
That the said Grantor for valuable consideration does by these
presents grant unto the Grantee a perpetual right-of-way or easement
for sewer mains with the necessary appurtenances through, over and
across the following described property situated in King County,
Washington.
The Northerly 25 feet of that portion of the West 1/2 of the
West 1/2 of the NW 1/4 of Section 6, Township 21 North, Range 5
East, W.M., lying Southerly of the Southerly margin of 37th Street Northeast
(South 292nd Street), and Westerly of the Westerly margin of "C"
Street Northeast (88th Avenue South).
TOGETHER WITH a temporary construction easement described as
the Northerly 65 feet of the said portion of the West 1/2 of the
West 1/2 of the NW 1/4.of Section 6.;
Granting of this Easement shall in no way hinder grantor from full
and free access to his property nor shall development or construction be in
any way affected.
Said temporary construction easement shall remain in force
during constzuction and until such time as the sewers and appur-
tenances have been accepted for maintenance and operation by the
City of Auburn.

That said Grantee shall have the right without prior
institution of any suit or proceeding at law, at times as may
be necessary, to enter upon said property for the purpose of
constructing, repairing, altering, or reconstructing said Sewer
Main, or making any connections therewith, without incurring any
legal obligation or liability therefor; provided that such con-
structing, repairing, altering or reconstructing of said Sewer
Main shall be accomplished in such a manner that the private
improvements existing in this right-of-way shall not be disturbed
or destroyed, or in the event they are disturbed or destroyed,
they will be replaced in as good a condition as they were immedi-
ately before the property was entered upon by the Grantee.
The Grantor shall retain the right to use the surface of
said easement, so long as said use does not interfere with the
installation and maintenance of the Sewer Main, and so long as
no permanent buildings or structures are erected on said easement.
This easement shall be a covenant running with the land and
shall be binding on the successors, heirs, and assigns of both
parties hereto.
