For and in consideration of TWO THOUSAND AND N01100 Dollars ($2,000.00) and
other good and valuable consideration in hand paid, receipt of which is
hereby acknowledged, and for benefits to be derived by the Grantor herein,
Grantor, CRISTA MINISTRIES, a non-profit Washington Corporation, located at
19303 Fremont Ave., North, Seattle, WA 98133 hereby conveys and warrants
to Grantee, THE CITY OF AUBURN, a Municipal Corporation of the State of
Washington, located at 25 West Main Street, Auburn, WA 98001, its
successors.-and--assigns,--a- _temporary: nonexclusive--easement- under, over,
through and across the following described land for the purpose of
constructing, installing, maintaining, repairing and monitoring two (2)
ground water monitoring wells, said land being described as follows:
LOT D, AUBURN SHORT PLAT #20-80, AS RECORDED UNDER SURVEY NUMBER
81.01079005, AND CORRECTED BY AFFIDAVIT UNDER RECORDING NUMBER
8104280802, BEING A PORTION OF HARVEY H. JONES DONATION CLAIM IN
SECTION 6, TOWNSHIP 21 NORTH, RANGE 5 EAST, W.M., IN KING COUNTY,
WASHINGTON.
Said Grantee shall have the absolute right, at times as may be necessary,
to enter upon said temporary easement for the purpose of constructing,
installing, maintaining, repairing and monitoring the two (2) ground water
monitoring wells without incurring any legal obligation of liability
therefor.
This temporary easement will expire two (2) years after the date of
execution of this Temporary Easement or at such time as the CITY OF AUBURN
issues grading or construction permits for the above-described parcel,
whichever occurs first. After Grantee's receipt of notice from Grantor
that the first of the two above-described events has occurred, Grantee CITY
OF AUBURN will, using current standards, decommission the two (2) ground
water wells.
This temporary easement shall be a covenant running with the land and shall
be binding on the successors, heirs and assigns of all parties hereto for
the period of time hereinabove set forth.
