WITNESSETH: That the said Grantor for valuable consideration does by these presents grant unto the Grantee a perpetual right-of-way or easement for sewer mains and pump station with the necessary appurtenance through, over and across the f-ollowinr, described property situated . in King County, Washington, more particularly described as follows: That portion of the Southeast quarter Section 12, Tonwship 21 North, Range limits of a strip of land 30 feet in is described as follows: Beginning at the intersection of the east quarter with the Easterly margin along said Northerly line 30 feet to description; also of the Northwest quarter of 4 East, W.M., included within the width the Northerly margin of which Northerly line of the said South- of "M" Street; thence, Easterly the terminus of said margin A strip of land 30 feet in width the Northerly margin of which is described as beginning at the intersection of the said Northerly line and the Westelry margin of the Puget Sound Power and Light right of way; thence Westerly along said Northerly line 75 feet to the terminus of said margin description; also The Northerly 1O feet of that portion of the said Southeast quarter lying Easterly of the Easterl; marni n !~f "M" Street and wPstarly of the Puget Sound Power and Light right of way. Together with a temporary construction easement 50 feet in width the Northerly margin of which is described as follows: Beignning at the intersection of the Northerly line of the said South- east quarter with the Easterly margin of "M" Street; thence Easterly along said Northerly line 50 feet to the terminus of said margin description; also A strip of land 50 feet in width the Northerly margin of which is described as beginning at the intersection of the said Northerly line with the Westerly margin of Puget Sound Power and Light right of way; thence Westerly 100 feet to the terminus of said margin description; also s 1% EXCISE TAX NOT REQUI•REM King Co. Said temporary construction easement shall remain in force during construction and until such time as the sewers and appurtenances have been accepted for maintenance andoperation by the City of Auburn. Easement No. 78-12-3 That said Grantee shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said property for the purpose of constructing, repairing, altering, or reconstructing said Sewer Main and pump station, or making any connections therewith, without incurring any legal obligation or liability therefor; provided that such constructing, repairing, altering or reconstructing of said Sewer Main and Pump Station shall be accom- plished in such a manner that the private improvements existing in this right-of-way shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good.a condition as they were immediately before the property was entered upon by the Grantee. The Grantor shall retain the right to use the surface of said easement, so long as said use does not interfere with the installation and maintenance of the Sewer Main and Pump Station, and so long as no permanent buildings or structures are erected on said easement.
