D 1 WITNESSETH: That the said Grantor for valuable consideration does by these -presents grant unto the Grantee a perpetual right-of-way or easement for sewer mains with the necessary appurtenances through, over and- across the following described property situated in King County, Q Washington. The Easterly 20 feet of that portion of the SW 1/4 of the NW 1/4 of Section 12, Township 21 North, Range 4.East, W.M., lying Westerly of the Westerly margin of SR 167 and Northerly of the North- erly margin of the 15th Street Northwest Extension as delineated on that certain Washington State Highway Commission right-of-way draw- ing SR 167 MP 13.66 to MP 17.42, Auburn: 1.7th St. SW to S.285th St., sheet 7 of 30 sheets, bearing date of approval June 12, 1969 and re- vised September 25, 1969. TOGETHER WITH a temporary construction easement described as the Easterly 50 feet of the said portion of the SW 1/4 of the NW 1/4 of Section 12. Said temporary construction easement shall remain in force during construction and until such time as the sewers and appur- tenances have been accepted for maintenance and operation by the City of Auburn. M r y~ ~ L 1T'1 ~Basement n~ .J . w No.79-•12-1 That said Grantee shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said property for the purpose of constructing, repairing, altering, or reconstructing said Sewer Main, or making any connections therewith, without incurring any legal obligation or liability there- for; provided that such constructing, repairing, altering, or recon- structing of said Sewer Main shall be accomplished in such a manner that the private improvements existing in this right-of-way shall not be disturbed or destroyed, or in the event they are disturbed or de- stroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. l The Grantor shall retain the right to use the surface of said easement, so long as said use does not interfere with the installa- p tion and maintenance of the Sewer Main and so long as no permanent CD buildings or structures are erected on said easement.
