NON-EXCLUSIVE PRIVATE SEWER EASEMENT

This Non-Exclusive Private Sewer Easement ("Easement") is made and entered into this
day oAJE , 1995, by and among the Heirs and Devises of Florence K. Lone, deceased;
Stephen F. Lone, Jr.; Richard Burnham; Howard Burnham; John Stalder; Jeff Ames; Jean M.
O'Brien; Nancy Flink; Joan Collins; David Brandmeir; and Maribeth Brandmeir (collectively
"Grantors").

WHEREAS, Grantors are the owners of real estate described as Parcel "A" and Parcel
"B," City of Auburn Lot Line Adjustment, LLA 0007-95, as recorded under Recording No.
9504251592, Records of King County, Washington;

WHEREAS, the City has indicated a willingness to grant Grantors the right to jointly use
and extend an existing sewer line system to serve Parcel "A" and Parcel "B";
NOW THEREFORE, for good and valuable consideration, including but not limited to the
provisions hereof, the receipt and adequacy of which consideration are hereby acknowledged, the
parties hereby agree that:

1. Grantors hereby grant to the owners, heirs, and assigns of Parcel "A" a perpetual
NonExclusive Easement from the 8" Sanitary Side Sewer Stub-Out (the "Stub-out"),
together with the right, privilege, authority and immediate entry and continued access to
construct, improve, maintain and repair a sanitary sewer pipeline, and other appurtenant
sewer structures over, under, upon and across a strip of land described in Exhibit "A'
attached hereto.
2. The owners, heirs, and assigns of Parcel "A" will indemnify, defend, and hold harmless
Grantors, their agents, tenants, successors and assigns, from and against all claims for
bodily injury (including death) and property arising from or occasioned by the work
performed thereon by the owner(s), heirs, and assigns of Parcel "A' and the rights herein

granted unless said injury or damage arises by reason of the sole negligence of Grantors,
its agents, tenants, successors or assigns.

3. The owner(s), heirs, and assigns of Parcel "A" shall restore the property to a neat and
orderly condition subsequent to any installation, construction, repair, and maintenance of
the sewer line from the Stub-out to its respective improvements situated on Parcel "B."
4. The owner(s), heirs, and assigns of Parcel "A" shall be responsible for the costs,
construction, hook-up, repair, stub out, and maintenance of the sewer line from the Stub-
out to its respective improvements situated on Parcel ' B." : '
5. Grantors, their heirs, and assigns shall have the right to connect to any sewer improvement
located in the easement granted herein without the payment of "late comer" fees or other
costs of anykind to the owner(s), heirs, and assigns of Parcel "A."
6. All parties hereto agree and understand that the City and furture owner of Parcel "B"
have no responsibility for the repair or maintenance of the private sewer line.
7. Any future purchaser of Parcel "A" from Grantors shall commence within one (1) year of
the date of closing of said purchase of Parcel "A" and thereafter process to completion the
construction, hook-up, stub-out, and all other improvements that are to be placed within
the easement granted herein.
8. This Easement shall be a covenant running with the above described real property and
burden said real estate, and shall be binding on the successors, heirs and assigns of all
parties hereto.
