E and Gertrude Y , h i s wife, hereinafter termed "Grantor". CG WITNESSETH: That the said Grantor for valuable consideration does by these presents grant unto the Grantee a 15 foot perpetual right-of-way or ease- ment for sewer mains with the necessary appurtenances through, over and across the following described property situated in King County,•Washington, more particularly described as follows: This Sewer Easement is through Tax Lot 13 in Section 12, Township 21 North, Range 4 East W. M. Said Tax Lot is described as follows: Southeast 1/4 of the Southwest 1/4 of said Section 12 EXCEPT the East 100 feet thereof conveyed to the Seattle-Tacoma Interurban Railway by deed recorded under #209774 records of King County, Washington. This easement consists of a 15 foot permanent strip described. as the East 15 feet of said Tax Lot. Joseph A Ey Easement No. 12 - 6 C'J CG . vat 4 7j j mf - That said Grantee shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said easement for the purpose of constructing, repairing, altering, or reconstructing said Sewer Main, or snaking any connections therewith, without incurring any legal obligation or liability therefor; providing that such constructing, repairing, altering, or reconstructMng of said sewer main shall be accomplished in such a manner that the private improvements existing in this right-of-way shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. Upon the completion of construction, the Grantee shall have all portions of land distuubed by construction reseeded with suitable meadow grass. The Grantor shall retain the right to use the surface of said easement for roadway or parking area purposes or for any other use which does not interfere with the Installation and maintenance of the sewer main and so long as no permanent buildings or structures are erected on said easement. This easement shall be a covenant running with the land and shall be binding on the successors, heirs, and assigns of both parties hereto. Leary Way Seattle, WA 98107 RE: Sanitary Sewer Easement North of 15th Street N. W. Dear Mr. Fiorito: This letter is a summary of the meeting regarding the above-referenced sewer easement. That meeting was held on September 7, 1978 and yourself, Mr. Neff, the.City and the firm hired to design the lift station and force main were present. The following proposal was presented to the Utility Committee and approved:. A separate LID would be formed between yourself, Mr. Neff and a third party west of West Valley Highway. Yourself and Mr. Neff would pay only an area charge equal to the same area charge paid by LID 294 participants (approximately two cents per square foot). There would be no front foot charge for yourself or Mr. Neff. Also, part of the agreement would be an extension from the lift, station of 50 feet of 8 inch sanitary sewer pipe with a manhole to serve both yourself and Mr. Neff. In return for the 50 feet of sewer pipe with a manhole and the assessment of only an area charge, the City would be granted a permanent sanitary sewer easement and a temporary construction easement for the force main and lift station (see letter dated August 30, 1978 for exact location of both easements).
