THIS AGREEMENT made this '31sT day of QUA 197,
by and.between the City of Auburn, a municipal coP. oration of King
County, Washington, hereinafter termed "Grantee" and

That the said Grantor for valuable consideration does by these
presents grant unto the Grantee a perpetual right-of-way or easement
for sewer mains with the necessary appurtenances through, over and
across the following described property situated in King County,
Washington.
The East 20 feet of the West 465 feet of that portion of the SW
1/4 of Section 12, Township 21 North, Range 4 East, W.M., lying
Northerly of the South 390 feet thereof; and lying Southerly of the
Southerly margin of the 15th Street Northwest Extension as delineated
on that certain Washington State Highway commission right-of-way
drawing SR 167 MP 13.66 to MP 17.42, Auburn: 17th St. SW to S. 285th
St., sheet 7 of 30 sheets, bearing date of approval June 12, 1969 and
revised September 25, 1969; also
The South 20 feet of the North 575 feet of the East 410 feet of
the West 445 feet of the SW 1/4 of the said SW 1/4; also
That portion of the said SW 1/4 lying Easterly of the West
465 feet thereof, lying Westerly of the Westerly margin of said SR 167,
and lying Northerly of a line described as follows:
Beginning at the intersection of the East line of the said West
465 feet with a line which is 20 feet Southerly of and parallel with
the Southerly margin of the said 15th Street Northwest Extension;
thence Easterly (in a straight line) to the intersection of the West-
erly margin of said SR 167 with a line which is 20 feet Southerly of
and parallel with the said Southerly margin of the 15th Street North-
west Extension.
TOGETHER WITH a temporary construction easement described as the
East 50 feet of the West 480 feet of that portion of the said SW 1/4
lying Northerly of the South 375 feet thereof; and lying Southerly of
the said Southerly margin of the 15th Street Northwest Extension; also
Gertrude A. Jones Easement No. 79-12-3R

The South 50 feet of the North 590 feet of the East 395 feet
of the West 430 feet of the SW 1/4 of the said SW 1/4; also
. That portion of the said SW 1/4 lying Easterly of the West
480 feet thereof, lying Westerly of the Westerly margin of said SR 167
and lying Northerly of a line which is 30 feet Southerly of and
parallel with the line described above.

Said temporary construction easement shall remain in force
during construction and until such time as the sewers and appur-
tenances have been accepted for maintenance and operation by the
City of Auburn.

That said Grantee shall have the right without prior institution
of any suit or proceeding at law, at times as may be necessary, to
enter upon said property for the purpose of constructing, repairing,
altering, or reconstructing said Sewer Main, or making any connections
therewith, without incurring any legal obligation or liability there-
for; provided that such constructing, repairing, altering, or recon-
structing of said Sewer Main shall be accomplished in such a manner
that the private improvements existing in this right-of-way shall
not be disturbed or destroyed, or in the event they are disturbed or
destroyed, -they will be replaced in as good a condition as they were
immediately before the property was entered upon by the Grantee.
The Grantor shall retain the right to use the surface of said
easement, so long as said use does not interfere with the installa-
tion and maintenance of the Sewer Main and so long as no permanent
buildings or structures are erected on said easement.
This easement shall be a covenant running with the land and
shall be binding on the successors, heirs, and assigns of both
parties hereto.
