HomeMy WebLinkAbout8208060376 SEWER EASEMENT 0806820. cp G d a a3 >1~f~11~ SCE60'J38 11H l C~a~fl3R ,82/08--`06 RECD CASHSL EASEMENT THIS AGREEMENT, made this ZZ,-,eA day of between the CITY OF AUBURN, a municipal corporation of King County, Washington, hereinafter termed "GRANTEE" and AUBURN LAND COMPANY, INC., a Washington corporation hereinafter. termed "GRANTOR WI TNESSETH: That The said Grantor fur valuable consideration does by these presents grant unto the Grantee a perpetual right of way or easement for sanitary sewer with the necessary appurtenances through, over and across the following described property, situated in King County Wasington, to-wit: The South 15 feet of the NE4 of SW4 of Section 12, Township 21 North, Range 4, East W.M. Less streets and state highway and Less the Puget Sound Power and Light Co. right of way. TOGETHER WITH a temporary construction easement described as follows: The North 30 feet of the South 45 feet of the NE4 of SW4 of Section 12, Township 21 North, Range 4, East W.M. Less street and state highway and Less the Puget Sound Power and Light Company right of way. Said temporary construction easement shall remain in force during construction and until such time as the sanitary sewer and appurtenances have been accepted for maintenance and operation by the City of Auburn. THAT said Grantee shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said property for the purpose of constructing, repairing, altering, or reconstructing said sanitary sewer, or making any connections therewith, without incurring any legal obligation or liability therefor; provided that such constructing, repairing, altering or reconstructing of said sanitary sewer shall be accomplished in such a manner that the private improvements existing in this right of way shall not be disturbed or destroyed, or in the event they are disturbed or destroyed they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. A 17 #0376 D 5.00 :+::i:*-*5„ 00 2.2 1982, by and Record and return to: y of Auburn 5 West Main Auburn, W ashinaton 98002. r The Grantor shall retain the right to use the surface of said easement, so long as said use does not interfere with the installation, maintenance and use of the sanitary sewer, and so long as no permanent buildings or structures are erected on said easement; provided however, the granting of this easement shall not be deemed to reduce the Grantor's maximum allowable use of Grantor's said property. As partial consideration for the granting of this easement, Grantors shall M not be charqed with any of the costs involved in the sanitary sewer referred O to herein, such as construction, engineering, legal, etc. QQ As further partial consideration for the granting of this easement, go Grantor, its heirs or assigns will be entitled to hook up to said sanitary sewer line without any charge being imposed by the Grantee. This easement shall be a covenant running with the land and shall be binding on the successors, heirs and assigns of both parties hereto.
