HomeMy WebLinkAbout9008310288 STORM EASEMENT 083190CIA DRAINAGE EASEMENT ti6 ~J IWO* GRANTOR, AUBURN LAND ASSOCIATES LIMITED PARTNERSHIP, for and in consideration of ONE DOLLAR ($1.00) and other valuable considerations, the receipt of which is hereby acknowledged, grants and conveys to GRANTEE, THE CITY OF AUBURN, an easement and right-of-way over, across, along, through and under the property attached hereto as Exhibit A, situated in the City of Auburn, King County, Washington, for the purpose of constructing, installing, reconstructing, replacing, maintaining and operating a storm sewer ditchline and pipeline and all necessary connections and appurtenances thereto, together with the right of ingress thereto and egress therefrom for the purpose of enjoying the easement. In addition, Grantee is hereby granted a temporary construction easement over Grantor's property as shall be required for the construction of the storm sewer ditchline and pipeline in the easement, such additional temporary easement to be over an area to be held to a minimum necessary for that purpose, and Grantee shall. not interfere with the use of Grantor's property. The temporary construction easement shall an expire twelve (12) months from the date of this Easement Agreement. Immediately after the completion of the construction and installation, or any subsequent entry upon the easement, C Grantee shall restore the premises as near as may be to its 9"1 condition immediately before such construction or entry. Grantee M warrants that design considerations and storm water release rates a} are such that flooding shall not occur on the Grantor's property, ? or on the property to the west of Grantor's property. Grantee further warrants that it has easement or other rights for storm sewer drainage over the property to the west of Grantor's property. This Easement Agreement shall expire at the time that the right-of-way for 10th Street N.E. is dedicated to public use.
