Q , by and between the City of Auburn, a municipal corporation of King County, Washington, hereinafter termed "Gantee" and P< l I^1G IQ A mo 1'-74717- and his termed "Grantor.". + N WITNESSETH: co" c:::- That the said Grantor for valubable consideration does by these CD presents grant unto the Grantee a perpetual right-of-way or easement _ for sewer mains and a sanitary sewer lift station with the necessary appurtenances through, over and across the following described pro- perty situated in King County, Washington. That portion"of Lots 21 and 22, Block 7, of C.D. Hillman's Auburndale Addition to the City of Seattle, Division No. 1, according to plat thereof recorded in volume 13 of plats, page 62, records of King County, Washington, and of vacated County Road No. 273 adjoining, lying Southerly and Westerly of the following described line. Beginning at a point on the West'line of said Lot 22 which is 50 feet Northerly of,the most Southerly corner thereof; thence Easterly at right angles.to said West line 45 feet; thence Southerly parallel with said West line to ari intersection with the Southeasterly line of said vacated portion of County Road No. 273 and the terminus of said.line description. TOGETHER WITH a temporary construction easement described as that portion of said Lots 21 and 22 and of vacated County Road No. 273 adjoining, lying Southerly of the following described line. Beginning at a point on the West line of said Lot 22 which is 80 feet'Northerly of the most Southerly corner thereof; thence Easter- ly at right angles to said West line, to the centerline of vacated Co.t ,Rp~d No. 273. Williams &•Smith• Easement.No. 60-8-1 That said Grantee shall have the right without prior institution of any suit or proceeding ~_t law, at times as may be necessary, to enter upon said property for the purpose of constructing, repairing, altering, or reconstructing said Sewer Main and pump station, or making any connections therewith, without incurring any legal obligation or liability therefor; provided that such constructing, repairing, altering or reconstructing of said Sewer Main and Pump Station shall be accom- plished in such a manner that the private' improvements existing in this right-of-way shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition N as-they were immediately before the property was entered upon by the Grantee. O co The Grantor shall retain the right to use the surface of said 0• easement, so long as said use does not interfere with the installation S and maintenance of the Sewer Main and Pump Station, and so long as no co permanent buildings or structures are erected on said easement. This easement shall be a covenant running with the land and shall be binding on the successors, heirs, and assigns of both parties hereto.
