That portion of the SW 1/4 of the NW 1/4 of Section 13, Town- ship 21 North, Range 4 East, W.M., included within the limits of a strip of land 20 feet in width the centerline of which is described as follows: Beginning at the intersection of the North line of the said SW 1/4 with a line which is 130 feet Westerly of and parallel with the Westerly margin of SR 167 as delineated on that certain Washing- ton State Highway Commission right-of-way drawing SR 157, MP 14.73 to MP 18.09 West Main St. to South 277th St.,sheet 16 of 92 sheets, bearing date of 'approval, March 13, 1970; thence Southerly along said parallel line to its intersection with a line which is 200 feet Northerly of and parallel with the FR LINE as delineated on said sheet 16; thence Southeasterly to a point which is 185 feet left (Westerly) of Highway Engineers centerline Station (SR 167) 546+85 and the terminus of said centerline description. TOGETHER WITH a temporary construction easement 100 feet in width the centerline of which is the same as that described above. AND ALSO the North 25 feet of that portion of the said SW 1/4 lying Westerly of the said Westerly margin of SR 167, and Easterly of the above described centerline. TOGETHER WITH a temporary construction easement 50 feet in width described as the North 50 feet of that portion of the said SW 1/4 lying Westerly of the said Westerly margin of SR 167 and Easterly of the above described centerline. Said temporary construction easement shall remain in force during construction and until such time as the sewers and-appur- tenances have been accepted for maintenance and operation by the City of Auburn. Records Division By Deputy I Record and ratura to City of Auburn 25 West Main fi Auburn, Washington 98002- That said Grantee shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said property for the purpose of constructing, repairing, altering, or reconstructing said Sewer Main, or making any connections therewith, without incurring any legal obligation or liability therefor; provided that such con- 01"% structing, repairing, altering or reconstructing of said Sewer ,4.. Main shall be accomplished in such a manner that the private O improvements existing in this right-of-way shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immedi- O ately before the property was entered upon by the Grantee. C) 00 The Grantor shall retain the right to use the surface of said easement, so long as said use does not interfere with the installation and maintenance of the Sewer Main, and so long as no permanent buildings or structures are erected on said easement. This easement shall be a covenant running with the land and shall be binding on the successors, heirs, and assigns of both parties hereto.
