Batting, his wife and W. Brown and Lois B. Brown , his wife, hereinafter called Roger L0 "Grantors", and CITY OP AU8MU1, a municipal corporation of King County, State of Washington, hereina- ter called "Grantee." V) ~k WITNESSETHs That said Grantor(s) for valuable consideration, do by these presents grant, bargain, sell,*lconvey, and confirm unto the said. Grantee, a right-of-way or easement for utilities, with necessary appurtenances over, through, across and upon the following~dd'cribed property situated in King County, Washington, particularly described as follows This Utility-Easement is through a portion of Tract "A" of n Vista as recorded in vol. 74 of Plats, page 90, Records of King County, Washington. This easement consists of a 10 foot permanent strip described as the North 10 feet (as measured at-right angles to the North line) of said Tract "A". TOGETHER WITH a 25 foot temporary construction easement de- scribed as the North 25 feet (as measured at right angles to the North line) of said Tract "A". Said temporary construction easement shall remain in force during construction and until such time as the sewers and appurten- ances have been accepted for maintenance and operation by the City of Auburn. Botting, et ux Easement No. 17-9 s5), PAGE670 E / The said Grantee shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary to enter upon said property for the purpose of constructing, repairing, altering o reconstructing said Utilities, or making any connections therewith, without incurrIng any legal dbligatioTi or liability therefor: provided L7 that such constructing, repairing, altering or reconstructing of said Utilities shall be accomplished in such a manner that the private im-- pa:ovehients existing in this right-of-wey shall not be disturbed or de- stroyed, or in the event iboy Fare disturbed or destroyed,, they will be replaced in as good a condition as they were immediately before the pro- perty was entered upon by the Grantee. The Grantor shall retain the right to use the surface of said ease- ment sQ long as said use does not interfere with the installation and maintenance of the Utilities and so long as no permanent buildings or structures are erected on said easement. This easement shall be a covenants cunning with the land and shall be binding on the Grantor's successors, ears and assigns.
