the sum of ONE DOLLAR ($1.00) in hand paid, receipt whereof is hereby acknowledged do
hereby grant, sell and convey to the City of Auburn ,
, Washington, a municipal corporation Grantee, its successors
and assigns, an easement and right-of-way, over, through, under, across, upon and in the
following described real property situate in King
County, Washington, TO-WIT:
That portion of Lot 1, Block 6, Abraham's Addition to Auburn, asrecorded in Volume
20, page 67, Records of King County, Washington described as follows:

operation, maintenance and/or repair and/or replacement of

with the right of ingress and egress to and from said easement and right-of-way for all
purpose necessary and related thereto.
This easement is granted with the understanding that the property affected
will be promptly and properly returned to a condition equal to its original condition
upon each and all completion of construction, operation, maintenance, use, repair and/or
replacement. The Grantee also agrees to indemnify and save harmless the grantors from
any liability arising from each and all uses contemplated herein. The Grantor agrees
that no structure will be eracted on the easement that would interfere with the use
contemplated without the written consent of the Grantee.
As a further part of the consideration for this easement, the Grantor
requires the following:

THIS INDENTURE, Made and entered into this 10th day of
February, A. D., 1927, by and between ROSE M. PAULEY, widow of
BENJAMIN S. PAULEY, late of Auburn, Washington, Deceased, OLIVIA
S. LNICKERBOCKER, daughter of said BENJAMIN S. PAULEY and 0. S.
LANING, husband of LAURA B. LAMING, who was also a daughter of
said BENJAKIN S. PAULEY, as parties of the first part herein, and
the City'-of Auburn, a city of the third class, situate in the
County of King, in the State of Washington, as party of the second
part herein,

That the said partiesof the first part for and in con-

sideration of the sum of One Hundred A,d"nci no/100 ($I 0.00) Dollars,
to them in hand paid, the receipt whereof is hereby acknowledged,
do hereby grant and quit-claim to the said party of the second
part a perpetual easement to construct, repair, keep in repair,
re-construct and maintain an outlet sewer pipe line from cer-
tain premises acquired by the said party of the second part for
a sceptic tank and sewage disposal over, under and across two
certain strips and parcels of land particularly bounded and
described as follows, to-wit:
One of said strips of land is Thirty-(30) feet in
width, measured as near as possible at right angles,
Fifteen and no/100 (15.00) Feet on each side of a
center line particularly described as follows:
Commencing at the northdast corner of erection Eigh-
teen, gownship Twenty-One ,(.21) Nortb of Range Five
(5) East, ~a . M., running thence iv o rth 890 51' 311,
West along the north line of said Section Eighteen
a distance of 388.56 fe$t to the true point of be-
ginning; thence South 3 13' 29" West a distance of
111.65 feet to a point; thence South' 230 08' 29" West,
a distance of 37.50 feet, more or less to lands being
conveyed to the City of auburn, for a sewage disposing
plant;

The other of which said strips of land is Thirty
(30) feet in width measured as near as possible
at right angles, Fifteen and no/100 (15.00) Feet
on each side of a center line particularly described
as follows, to-wit: Commencing at the northeast
corner of Section Eighteen (18) in 'T'ownship Twenty-
One (21) North of Range Five (5) East, W. M., running
thence North 890 51' 31" West along the north line
of said Section 18 a distance of 388.56 feet to the
true point of beginning; thence ivorth 30 131 29" East
a distance of 713.20 feet, more or lees, to the center
of the present channel of Green River.
It is understood and agreed by and between the grantors
herein and the grantee herein that the grantee herein shall have
the right to coonsgruct, keep in repair, maintain and re-construct
a forty-two (42") inch sewer outlet line over and across the two
(2) strips of land above described, and shall have the right to
provide a sewage outlet into Green River through an open ditch for
a reasonable distance back from the center line of Green River as
the same is now flowing.
It is further understood and agreed by and between the
parties herein that the title to the strips of land covered by
this easement, and the right to cultivate and enjoy the surface of
the soil shall be and remain in the parties of the first part herein,
and that the party of the second part herein shall pay to the parties
of the first part herein such damages, if any, as the parties of the
first part herein may sustain by reason of the party of the second
part herein hereafter, and after the first installation of an out-
let sewer pipe over said strips of land, repairing or re-placing of
any outlet sewer line.

That said Grantee shall have the right without prior
institution of any suit or proceeding at law, at times as may
be necessary, to enter upon said property for the purpose of
constructing, repairing, altering, or reconstructing said facility,
or making any connections therewith, without incurring any
legal obligation or liability therefore; provided that such
constructing, repairing, altering or reconstructing of said
facility shall be accomplished in such a manner that the private
improvements, existing in this right-of-way shall not be disturbed
r destroyed, or in the event that they are disturbed or destroyed,
ey will be replaced in as good a condition as they were immedi
tely before the property was entered upon by the Grantee.
0 The Grantor shall retain the right to use the surface
