C"V q WITNESSETH: +D That the said Grantor for valuable consideration does by these presents grant unto the Grantee a slope easement with the right to make all necessary slopes upon the abutting property for cuts and fills as may be required in the construction of roadway improvements on West main ;trpPt The slope easement is described as follows: The North 5 feet of the following described property lying East of the additional right-of-way acquired by the State Highway Department for the realignment of West Main Street: the West 3/8 of the Northeast 1/4 of the Southwest 1/4 of*QMA hw1Qt., Township 21 North, Range 4 East, W.M., LESS State Road and LESS County Road. Situate in the City of Auburn, County of King, State of Washington. bl~ That said Grantee shall have the right without prior institution of any-suit or proceeding at law, at times as may be necessary, to,enter upon said easement for the purpose of placement of roadway slopes without incurring any legal obligation or lia- bility therefor; provided that such construction shall be accomplished in such a manner that private improvements shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. This easement shall be automatically extinguished in the event grantor, its heirs, successors, and assigns, bring the lands herein burdened by the easement to the grade of grantees nearest pavement. This easement shall be covenant running with the land and shall be binding on the successors, heirs, and assigns of both parties hereto.
