That the said

Grantor for valuable consideration does by these
the Grantee a perpetual right-of-way or easement
the necessary appurtenances through, over and
described property situated in King County,
That portion of the SW 1/4 of Section 13, Township 21 North,
Range 4 East, W.M., lying Southerly of the North 30 feet thereof and
Westerly of the Westerly margin of SR 167, included within the
limits of a strip of land 20 feet in width the centerline of which
is described as follows:
Commencing at a point on the North line of the said SW 1/4
which is South 86014142" East 26.23 feet from the Northwest corner
thereof; thence South 12051107" West 30.38 feet to the Point of
Beginning; thence continuing South 12051107" West 41.45 feet; thence
South 28021'39" West 25 feet more or less to an intersection with
the West line of the said SW 1/4 and the terminus of said center-
line description.
TOGETHER WITH a temporary construction easement described as
that portion of the said SW 1/4 lying Westerly of the Westerly
margin of SR 167 and Southerly of the North 30 feet thereof.

Said temporary construction easement shall remain in force
during construction and until such time as the sewers and appur-
tenances haye.,been accepted for maintenance and operation by the
City of Auburn.

That said Grantee shall have the right without prior
institution of any suit or proceeding at law, at times as may
be necessary, to enter upon said property for the purpose of
constructing, repairing, altering, or reconstructing said Sewer
Main, or making any connections therewith, without incurring any
legal obligation or liability therefor; provided that such con-
structing, repairing, altering or reconstructing of said Sewer
Main shall be accomplished in such a manner that the private
improvements existing in this right-of-way shall not be disturbed
or destroyed, or in the event they are disturbed or destroyed,
UM they will be replaced in as good a condition as they were immedi-
M ately before the property was entered upon by the Grantee.
O The Grantor shall retain the right to use the surface of
CT said easement, so long as said use does not interfere with the
O installation and maintenance of the Sewer Main, and so long as
no permanent buildings or structures are erected on said easement.
This easement shall be a covenant running with the land and
shall be binding on the successors, heirs, and assigns of both
parties hereto.
