Q7, THIS AGREEMENT made this day of December, 1972, between the
vr~ CITY OF AUBURN, a municipal corporation of King County, State of Wash-
CD ington, hereinafter termed "GRANTEE" and Auburn Center Ltd. Partnership,
"GRANTOR".

M WITNESSETH: The GRANTOR does hereby grant to the GRANTEE and its
authorized agents a TEMPORARY RIGHT-OF-WAY or EASEMENT to be used during
construction of "A" Street SE and Burlington Northern Railroad bridge
improvements in the area between Cross Street SE and 6th Street SE, said
improvements being accomplished under URBAN ARTERIAL BOARD PROJECT NUM-
BER 8-1105-(13). The TEMPORARY EASEMENT shall terminate upon acceptance
of said improvements by the GRANTEE, BUT IN NO EVENT SHALL EXTEND BEYOND
DECEMBER 31, 1973. The temporary right-of-way or easement shall be
through and across the following described property situated in King
County, Washington, more particularly described as follows:

Lot 23; th NEly on a curve to the right having a radius of 10" to a

W 172.25 ft; th N 365.19 ft to beg, LESS the E 90 ft, situate in the
SW 1/4 of Sec 18, T 21N, R5EWM, City of Auburn, County of King,

THAT SAID GRANTEE shall have the right without prior institution
of any suit or proceeding at law, at times as may be necessary, to
enter upon said easement for the purpose of placement of roadway
slopes without incurring any legal obligation or liability therefor;
provided that such construction shall be accomplished in such a
CO manner that private improvements shall not be disturbed or destroyed, ;
