EASEMENT
THIS AGREEMENT made this 1st day of October, 1968, by and,
between the CITY OF AUBURN, a municipal corporation of King County,
Washington, hereinafter termed "Grantee". and. Auburn West Associates,
a Washington limited. partnership, By: Investment Exchange Corporation,
general partner, hereinafter termed "Grantor".

WITNESSETH:
That the said Grantor for valuable consideration does by these presents
grant unto the Grantee a slope easement with the right to make all necessary
slopes upon the abutting property for cuts and fills as may be required in the
construction of roadway improvements on West Valley Road.
The slope easement is described as follows:
The west 10 feet, measured perpendicularly to West Valley Road., of
the following described parcels:
That portion of the Northwest Quarter of the Northeast Quarter of
Section 23, Township 21 North, Range 4 East W. M. , described as follows:
Beginning at the Northeast corner of Section 23 and running thence
South 89058' 1511 West along the North line of said Section 23, a distance of
1315.84 feet to the 1/16th subdivision corner; thence South 0042121" West
12. 0 feet to the true point of beginning; thence South 0042'21" West 650. 56
feet;
thence South 89055155" West 1045. 38 feet to the Easterly line of State Highway;
thence North 3000111511- East along said Easterly line of State Highway 511. 22
feet;
thence North 89058' 1511 East 269. 08 feet;
thence North 0001145" West 208. 71 feet to a point 12. 0 feet South of the North
line of said Section 23;
thence North 8905811511 East parallel to the North line of said Section 23, a
distance of 528. 65 feet to the true point of beginning.
The North Half of the Northeast Quarter of the Northeast Quarter and the
North 12 feet of that portion of the Northwest Quarter of the Northeast
Quarter lying East of West Valley Road, ALL in Section 23, Township 21
North, Range 4 East W.M. ; situate in the City of Auburn, County of King,
State of Washington.
Easement No.8
That said. Grantee shall have the right without prior institution of any
suit or proceeding at law, at times as may be necessary, to enter upon said
easement for the purpose of placement of roadway slopes without incurring
any legal obligation or liability therefor; provided that such, construction
shall be accomplished. in such a manner that private improvements shall
not be disturbed or destroyed, or in the event they are disturbed or destroyed,
they will be replaced in as good a condition as they were immediately before
the property was entered upon by the Grantee.
This easement shall be automatically extinguished. in the event grantor,
its heirs, successors, and assigns, bring the lands herein burdened by the
easement to the grade of grantees nearest pavement.
This easement shall be a covenant running with the land and shall be
binding on the successors, heirs, and assigns of both parties hereto.
