HomeMy WebLinkAbout7402130508 SEWER EASEMENT 021374CONSTRUCTION EASEMENT THIS AGREEMENT made this day of January , 1974 , between the CITY OF AUBURN, a municipal corporation of King County, State of Washington, hereinafter termed "Grantee" and M & S Land Corporation "Grantor". WITNESSETH: The Grantor does hereby grant unto the Grantee and its authorized agents a 'CD temporary right-of-way or easement to be used only during construction of a sanitary sewer and water main on adjacent property; said temporary easement CV ~ shall terminate upon acceptance of the sanitary sewer and watermain for maintenance and operation by the Grantee. The said temporary right-of-way or easement shall f`- be through and across the following described property situated in King County, Washington, more particularly described as follows: I The South 30 feet of the West 406 feet of the SW 114 of the NW 114 of I Section 20, Township 21 North, Range 5 EWM., situate in the City of Auburn, County of King. The Grantor; or its assigns, shall have the right at any time to connect any of its properties abutting said water and sewer line between "R" Street S.E. in Auburn, Washington, and the easterly terminus of said easement without charge or assessment., excepting normal meter- charges and permit fees. Any damage to existing roadway or fence will be repaired or replaced if damaged. Schuler, Planning Director City of Auburn 20 A St. Northwest Auburn, Wash. 98002 Dear George: We are attempting to record-M S`tand,-Corporation's version of the proposed water and sewer line construction along the co South boundary of our White Lake propei4y and associated problems. CD r CD' We have been trying during the past months to solve the alignment C) problem that will exist when 17th Street S. E. is extended East CV of R Street. As you are aware the construction of a new house CD. on the property South of our property will not allow the normal practice of constructing 17th Street with a 60 foot right of way with 30 feet of property taken from each of the adjoining ! property owners. i The inability of the City to obtain property at any price from the same ownership for the construction of the East half of R Street S. E. leads us to the conclusion that if the City does not obtain a reasonable alignment for the 17th Street extension when these property owners are requesting services from the City the future construction of 17th Street will be effectively blocked. You have asked us for a construction easement to allow construction of water and sewer services to the new house that has blocked the extension of 17th Street. We are willing to grant this easement for the following considerations: 1. Any damage to the existing road and fence will be repaired. 2. M & S Land Corporation will be allowed to connect to these water and sewer lines at no charge to them. 3. M & S Land Corporation will not be required to give right of way for 17th Street construction at anytime in the future. We will eliminate consideration of construction of 17th Street in our planning. We feel it is very unfortunate that we will be unable to use 17th Street as it is the logical connection for future access to this area.
