HomeMy WebLinkAbout9505030420 EASEMENT 050395s , -:a, (14 i~6~ ^1'1GC` 3"~'s~~'9iYC16f14 25 98W' ~JC ZC~ Z f-Ac.oa 18 -q y MAY Q 1 1995 KING COUNTY RECORDER EASEMENT FOR ROAD PURPOSES G Cat R1' C M fl For and in consideration of one dollar ($1.00) and other valuable consideration, the receipt of which is hereby acknowledged, the Muckleshoot Indian Tribe ("Grantor") hereby grants and conveys to the City of Auburn, a municipal corporation of the State of Washington, ("Grantee"), for the purposes hereinafter set forth, a non-exclusive easement for the purpose of public ingress and egress, including laying, maintaining and installing a public street and the appurtenances thereof, over, across and under the following described real property (the "Property") in King County, Washington, on the Muckleshoot Indian Reservation: The West 500 feet of the Southeast quarter of Section 20, Township 21 North, Range 5 East, W.M.; EXCEPT that portion lying within the plats of "Skycrest Terrace Division 2" as recorded in Volume 101 of plats, page 55, and "Greentree" as recorded in Volume 22 of plats, pages 78 thru 81, records of King County; AND EXCEPT that portion lying Southerly of the Northerly margin of State Highway 164, (Auburn Way South). Except as may be otherwise set forth herein, Grantee's rights shall be exercised upon that portion of the Property (the "Easement") described as follows: An easement sixty-five (65) feet in width measuring 33.5 feet west of the centerline of the constructed roadway and 31.5 feet east of the centerline of the constructed roadway and one hundred and fifty (150) feet in length from the southern boundary of the Property at the intersection of Howard Road and Auburn Way South northerly across the 8 Property. M 1. Purpose. Grantee shall have the right, at such times as may be necessary, for immediate entry upon said Easement for the purpose of maintenance, construction, repair or reconstruction of the above improvements. Grantee shall have the right of access to the Easement over and across the Property to enable Grantee to exercise its rights hereunder, provided that Grantee shall compensate Grantor for any damage to the Property caused by the exercise of said right of access. 3. Grantor's Use of Easement. Grantor reserves the right to use the Easement for any purpose not inconsistent with the rights herein granted. 4. Indemnity. By accepting and recording this easement, Grantee agrees to indemnify and hold harmless Grantor from any and all claims for injuries and/or damages suffered by any person, which may be caused by the Grantor's exercise of the rights herein granted, provided, that Grantee shall not be responsible to Grantor for any injuries and/or damages to any person caused by acts or omissions of Grantor. 5. Abandonment. The rights herein granted shall continue until such time as Grantee ceases to use the Easement or abandons the Easement, or the Grantor determines that it no longer desires public ingress and egress to and from the Property by way of this Easement. 6. Jurisdiction. Nothing contained in this Easement for Road Purposes is intended to, nor shall it be construed to, act as a grant of jurisdiction to, or recognition of authority of, the Grantee over the Grantor, Tribal lands, Tribal businesses, or any and all other persons, activities and properties within the exterior boundaries of the Muckleshoot Indian Reservation.
