3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE CONSTRUCTION
AND INSTALLATION OF CURB AND.GUTTER, STREET PAVING, SIDEWALKS, STORM
4 DRAINAGE, STREET LIGHTS, WATER MAINS AND SANITARY SEWERS, ON 18TH STREET
N.E. BETWEEN "I" STREET N.E. AND "K" STREET N.E., DESCRIBED IN SECTION 2
5 OF THIS ORDINANCE; CREATING AND ESTABLISHING LOCAL IMPROVEMENT DISTRICT
N0. 325; PROVIDING THE METHOD OF ASSESSMENT IN SAID DISTRICT AND THE MODE
6 OF PAYMENT THEREOF, AND CREATING A LOCAL IMPROVEMENT FUND THEREFOR.

WHEREAS, a petition has been filed with the City Council of the City of

Auburn, signed by the owne"rs of the property aggregating a majority (1) of the
9 .
, lineal frontage upon the improvement and (2) of the area within the proposed
, 10
district,.setting forth.the nature and territorial extent of the proposed
ll
improvement, the mode of payment and what proportion of the lineal frontage
12 ,
upon the improvement and of the area within the proposed district is owned by
13
the petitioners as shown by the records in the Office of the County Auditor
14
for King County; Washington, petitioning for the construction and installation
15 . , of curb and gutter, street paving, sidewalks, storm drainage, street lights,
16
water mains and sanitary sewers;. on'•18th'Street N.E. between °I" Street N.E.

and "K" Street N.E., legally described in Section 2 of this Ordinance, inside
18 , . the corporate limits'of the City of Auburn; and

2o WHEREAS, the City Engineer has caused an estimate to be made on the cost
21 and expense of the proposed improvement and has certified said estimates to
22 the City Council, together with all papers and information in his possession
23 touching the proposed improvements, a description of the boundar.ies of the
24 district,'a statement of what portion of the costs and expense of the improve-
~
25 ments sho \ uld be borne by the property within the proposed district, a state-
26 ment in detail of any local improvement assessments outstanding and unpaid
27 against the property in the proposed district, and a statement of the aggre-
28 gate actual valuation of the real estate and the actual valuation of the
29 improvements in the proposed district according to the valuation last placed
30 upon it for the purpose of general taxation; and
31 WHEREAS, said estimates are accompanied by a diagram of the proposed
32 improvements showing thereon the lots, tracts and parcels of land and other

property which will be especially benefited by the proposed improvements and

the estimated amount of the cost and expense thereof to be borne by each lot,

tract and parcel of land or other property.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON DO
5 ORDAIN AS FOLLOWS:

Section 1. That the property legally described in Section 2 of this
7 .
- Ordinance, situate inside the corporate limits of the City of Auburn, be
8
improved b'q the construction and installation of curb and gutter, street.
9
10 Paving, sidewalks, storm drainage, street lights, water mains and sanitary
11 sewers, on 18th Street N.E. between "I" Street N.E. and "K" Street N.E:, all ,
12 in accordance with plans and specifications prepared by the City Engineer and
13 filed with the City Clerk. ,
14 Section 2. That there is hereby created and established a Local
15 Improvement District to be designated Local Improvement District No. 325,

Section 3. That the estimated cost in carrying out the foregoing improve-
26 ment is hereby declared to be as near as may be, the sum of $269,448.21.

Section 4. Applicable costs and expenses of all engineering, legal,
28
, inspection, advertising, publication and notices, and all other expenses inci-
29 .
dent thereto, shall be levied and assessed against all of the property legally
30 .
and properly assessable:therefor, as provided by the laws of the State of
31 '
Washington and the Ordinances of the City of Auburn.

1 Section 5. That said improvements shall be made by the City of Auburn
2 under the supervision of the City Council thereof or such committee or person
3 as the City Council may designate.
4 Section 6. Assessments or any portion thereof, may be paid at any time
~
5 within thirty (30) days from the date of the first pub}ication of the Notice
6 of Collection of such assessments without penalty, interest, or cost, and
7 thereafter the sum remaining unpaid, if any, may be paid in ten (10) equal
8 annual installments, with interest on the whole unpaid sum at the rate of one
9 half. (112) of one percent (1%) in excess of the net effective rate of the
10 Loca1 Improvement District bonds with the interest in.no case being greater
11 than thirteen percent (13%).
12 Cormnencing with the first year after the last day, such assessments, or
13 any por.tion thereof, may be paid.without penalty, interest or cost (th9rty
14 (30) days from the date of the first publication of the Treasurer's Notice of
15 Collection of Assessments) and each year thereafter one of said installments,
16 together with the interest due, shall be collected as provided by law and the
17 Ordinances of the City of Auburn; assessments or installments of assessments
18 not paid vihen due shall be delinquent and there shall be added to the same a
19 penalty of twelve•percent (12%) of, the amount of the overdue installments and
20 interest, and such penalty shall become a part of the lien upon the property
21 assessed.
22 Section1 7. That there is hereby,created in the Office of the Finance
23 Director for the City of Auburn, a fund of the City to be known as "Local
24 Improvement District No. 325 Fund." Warrants shall be drawn on said fund
25 based on estimates made by the City Engineer and approved by the City Council
. 26 in payment of the cost of construction and installation of said improvements.

1 Section 8. The Mayor is hereby authorized to implement such administra-
2 tive procedures as may be necessary to carry out the directions of this
3 legislation.
4 Section9. This Ordinance shall take effect and be in for,ce five (5) days
