WHEREAS,. the'City Counc.i.l of the City of.Auburn, Washington, have passed
s and adopted Resolution No. 1260, resolving that a public hearing sfiall be had.

sented to the City Council at said hearing altfiough the Auburn City Council

22 requested that the request,.for street vacation be referred to the Auburn City
23 Counc.il $treet,Committee for further study'and discussion thereon;.and
' WHEREAS, the:Auburn City Council Street,Committee at their meeting of

. 25 -0ecember 9, 1981, approved the request'for street vacation; and
26 WHEREAS~, the; Auburn City Council at their regular meeting of December 21;
27 1981, having deemed,that the petition for vacation was proper and that no
28 vested rights would be affected by the same; . .

1 Section 1. That"the following described portion of a certain street
2 right-of-way situated on a portion of 29th Street N.W. lying between SR 167
3 (Valley freeway) and a point approximately 300 feet west of.SR 167, within the
¢ corporate limits of tfie City of Auburn, Washington, and more particularly
5 described as follows, to-wit: •
6 Beginning at the northwest corner of Lot 4 City of Auburn Short
, Plat No. SP-32-79 as recorded under King County Auditors File No.
~ 7 7912260412; thence east along the north line of said,Lot 4, 100
, feet to the true point of beginning; thence north at right angles
~I 850+ ft to the nonth line of 29th St. N.W. as dedicated in the
~ Plat of Christopher Garden Tracts, Volume 23, page 6; thence east
O 9 along the north line of 29th St. N.W. to the west line of SR 167;
~i thence south along the west line of SR 167 50+ ft to the extended
10 north line of aforesaid Lot 4 Short Plat No. SP-32-79; thence
, d, west along the extended north line and the north line of Cot 4
C-3' 11 said short plat to the true point of beginning. Together with
~ that portion of right of way dedicated to the City of Auburn
12 under King County.Auditors File No. 7402270280 abutting the west
side.of SR 167 and lying between Highway Stations 637 + 72:78
13 and 638 + 62.85 all situated in the SW; Sec 1, Twp 21 N,R 4 EWM
King County, WA and be•ing a portion of 29th St.. N.W. lying east
14 of the West Va11ey Highway.
15 be and the same is Fiereby vacated, and the property lying in said portion of a
16 certain street right-of-way described hereinabove, shall be`returned and
17 belong to the abutting property owners, of said portion of a certain street
- 18 right-of-way located on a portion of 29th Street N.W. lying between SR 167
19 (Valley Freeway) and a point approximately 300 feet west of SR. 167, lying
20 within.the corporate limits of the City of Auburn, Washington.
21 Section 2. That the request for vacation of street right-of-way be granted
22 subject to a public utility easement over, across, upon and underneath the
23 entire vacated street for ingress and egress for the purpose of ins"talling and
24 maintaining all public utiTities.
25 Sectiorr 3. Upon the passage; approval and publication of this Ordinance,

the City Clerk shall cause a certified copy of this Ordinance to be recorded in
, 27 the off,ice of theiKingCounty;Auditor.'-
28 Section 4 TheMayor isthereby authorized to implement such.administra-

tive procedures as'may be necessary to carry out the directions of this
30 legislation.
