3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING AUBURN CODIfIED LITY
ORDINANCE 9.24.090 (PUBLIC CONSUMPTION-LIQUOR OR ALCOHOLIC BEVERAGES-
¢ PROHIBITED).TO INCREASE THE PENALTY FOR VIOLATION THEREOF FROM NOT
MORE THAN TEN DOLLARS TO NOT MORE THAN ONE HUNDRED DOLLARS AND ADDING
5 SOME CLARIFYING TERMINOLOGY THERETO.

THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. Auburn Codified City Ordinance 9.24.090 is hereby amended to

read as follows, to-wit:

"9.24.090" Public consumption prohibited.

Except as permitted by the Washington State Liquor Act
11
(Chapter 62, Laws of 1933, Ex. Sess., as amended), no person
12 .
shall-open a package or container containing liquor or 'alco- `
13
holic beverages' or consume liquor or any other 'alcoholic
14 .
15 beverages on'any public ways or thoroughfares or in any
16 public pTace within the city limits. It is further unlawf,ul
.
17 for any person to open any package or container containing
liquor or,other alcoholic beverages or consume liquor or any
18
19 othe'r alcoholic beverages in any vehicle situated upon the
20 ,:public streets or alleys of the city. For the purpose of
, 21 this section, possession of an open coritainer or package of
22 aleoholic beverages in the places described hereinabove shall
23 . be prima facie evidence of a violation of this section.
24 Unless another penalty is expressly provided by law,
,
25 every personconvicted of a violation of this section shall
26 be punished by a fine of not more than ((+en)) one hundred
27 dolTars."
28 Section 2. The Mayor is hereby authorized to implement such administra-
t.;.`; ~ .
29 tive proc`edures.as.may be nece`ssary to,carry out the direction of this
30 legis9ati;on.
